185 In the year of our Lord One thousand Seven hundred and forty One at Somerset County was Indebted unto the same John Henry in the sum of Six hundred forty and Eight pounds of tobacco for sundry articles properly Chargeable in account as by an account thereof hereinto Court brought may appear and so thereof Indebted being the said John M.ccClester in Consideration thereof afterwards (to witt) the same day and year af.d at the County af.d upon himself did assume and to the same John Henry then and there did faithfully promise that he the said John M.ccClester the same Six hundred and forty eight pounds of tobacco unto the af.d John Henry when thereof Requested would well and faithfully pay and Content Nevertheless the af.d John M.ccClester his promise and assumption af.d in form af.d made Little regarding but minding and fraudulently Intending the same John Henry in that part Craftily and Suttlely to deceive and defraud the af.d Six hundred forty and Eight pounds of tobacco or any pound thereof unto the same John Henry Altho' the same to do the af.d John M.ccClester afterwards to witt the same day and year af.d and often since that time at Somerset County af.d by the same John Henry ^requested^ hath not paid but the same to him to pay or Content hetherto hath refused and still doth refuse to the damage of the same John Henry Ten pounds Currt money of maryland and thereof he brings suit &.a Pledges &.a J Doe & R Roe
A Copy of the foregoing decleration was made and sent to be served on the deft with the writt in order for a speedy Tryall Att which day here Came the af.d John Henry by his attorny af.d and the sheriffe to witt John Handy Gent now here Returned that he |
