18 the value of thirty pounds Current money of the province af.d & thereof he brings Suit &c Pledg.s &c J Doe & R Roe And the aforesaid James Quatermus by Francis Allen his attorney Comes and defends the force and Injury when &,a and prays Leave thereof to Imparle hereuntill next Court to be held at dividing Creek in & for the County aforesaid the third Tuesday of November then next following and he hath it and the same day is given to the aforesaid Jean John and Ann Polk here also &a Att which day here Came againe as well the aforesaid Jean John and Ann Polk by their attorney aforesd as the aforesaid James Quatermus by his attorney aforesaid Whereupon it appears to the Court here that the parties aforesaid by the assent of their attorneys had refered their dispute in this action now depending between them to the Arbitrament of Robert King and Nehemiah King of the County afd Gentlemen so that they return their arbitrament in writing under their hands and seals to the next Court to be held at dividing Creek in and for the County afd third Tuesday of March then next following and further it doth appear to the Court here that the parties aforesaid had Submitted and agreed that the Justices of the same Court should give Judgment upon the Same Arbitrament against either of ^the^ parties afd as if the Same Cause had been determined by this Court and it is further agreed between the parties aforesaid that that Submission should be made a rule of this Court Therefore it is Ordered by the Court here that the Submission aforesaid in manner and form aforesaid made according to the form and Effect of the Statute in that Case Lately made and provided be Entered and made a rule of this Court at the request of the parties aforesaid and the same day is given to the parties aforesaid here &a Att which day here Came againe as well the aforesaid Jean John and Ann Polk as the aforesaid James Quatermus by their attorneys aforesaid And the afd Arbitrators at the Same day did not return any arbitrament from under their hands and seals in writing agreeable to the above Submission between the parties aforesaid Thereupon by the Consent of the parties aforesaid further day is given by the Court here unto the afd Arbitrators to return their arbitram.t between the parties afd in the premisses above untill next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of June the next following and the same day is given to the parties afd here &a Att which day here Came againe as well the af.d Jean John and Ann Polk as the af.d James Qu^a^termus by their Attorneys af.d and the af.d Arbitrators at the same day did not return any Arbitrament from under their hands and Seals in writing agreable to the above Submission between the parties af.d thereupon by ^the^ Consent of the parties af.d further day is given by the Court here unto the af.d Arbitrators to return their arbitrament between the parties af.d in the premisses above untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of August then next Following and the same day is given to the parties af.d here &a Att which day here Came againe as well the aforesaid Jean John and Ann Polk as the aforesaid James Quatermus by their attorneys aforesaid and whereupon the aforesaid ^Arbitrators^ Returned to the Court here their arbitrament in the premisses aforesd between the parties aforesaid from under their hands in writing in form following In pursuance of a rule of Somerset County Court according to the form of the Statute in Such Case provided for Submitting the matters in diferrence |
