17 Whereupon the af.d Benjamin Sharp by the assent of the afd Littleton Townsend is discharged by the Court here from the Committment af.d &.a Therefore it is Considered that the af.d Littleton Townsend Administrator of ^the afd^ Job Sherry Recover against the af.d Benjamin Sharp his debt af.d and his damages by Occasion of the detaining 396 of the same debt to pounds of tobacco to the same Littleton Townsend Administrator as af.d of his assent by the Court here adjudged and the af.d Benjamin in Mercy &.a
of a plea of trespass upon the Case &.a And the same day is given to the af.d Jane John and Ann here &.c Att which day here Came the af.d Jane Polk John Polk and Ann Polk by Robert Jenckins Henry their Attorney af.d the sheriff to witt John Henry Gent now here returned that he had taken the af.d James Quatermus whose body her at this day he had ready to answer the af.d Jane Polk John Polk and Ann Polk of the af.d plea as to him it was Commanded And the aforesaid Jane John and Ann Complained against the aforesaid James Quatermus of the aforesaid plea in form following Somerset ss James Quatermus Late of Somerset County planter was attached to answer unto Jean Polk John Polk and Ann Polk of a plea of trespass upon the Case &a And Whereupon the same Jean John and Ann by Robert Jenckins Henry their Attorney Complains that whereas the af.d James the first day of May in the year of our Lord one thousand seven hundred thirty and Eight at Somerset County af.d was Indebted to the same Jane John and Ann in the sum of Fifteen pounds Current money of Maryland for the like Sum of money of the same Jean John and Ann and divers other persons to the profit and use of them the said Jean John & Ann by the af.d James before that time had and received and so thereof Indebted being the said James in Consideration thereof upon himself did assume and to the same Jean John and Ann then and there faithfully promise that he the said James the af.d fifteen pounds Current money of Maryland to the af.d Jean John and Ann when thereof he should be requested well and faithfully would pay and Content Nevertheless the af.d James his promise and assumption af.d little regarding but minding and fraudulently intending the same Jean John and Ann in that part Craftily and suttlely to deceive and defraud the af.d Fifteen pounds Current money or any penny thereof unto the same Jean John & Ann or either of them he hath not paid or in any sort hither^to^ Contented (altho the same to do the said James afterwards to witt the thirteenth day of may in the year af.d and often since that time at Somerset County af.d by the Same Jane John and Ann was requested whereupon the same Jane John and Ann say they are the worse & have damage to the |
