17 Whereupon the said Littleton says that he is damnifyed One hundred pounds Currt money of maryland and thereof he brings suit &.a and the said Littleton brings hereinto Court the Letters of Administration &.a by which &.a Pledges &.a J Doe & R Roe Whereupon the af.d Benjamin Sharpe at the prayer of the afd Littleton Townsend is adjudged to give Speciall Bail to the Action af.d Thereupon Came here into Court a Certain Joshua Tull of Somerset County planter in his proper person and undertook for the said Benjamin Sharp (Likewise the said Benjamin Sharp present herein court in his proper person assumed upon himself) that if it should happen that Judgment in the plea afd should be rendred for the af.d Littleton Townsend against the af.d Benjamin Sharp or that he the said Benjamin should be therein Convict that then he the af.d Benjamin should pay and satisfie unto the said Littleton the Judgment of the Court thereupon or render his body in execution of such Judgment to the prison of the Sheriff of the County af.d in Satisfaction thereof or that he the same Joshua Tull will do the same for him &a And afterwards to witt the Seventeenth day of June Ann.o Dom One thousand seven hundred and Forty the said Benjamin Sharp present here in Court in his proper person and hereupon the aforesaid Joshua Tull ^prays that^ and for his Indemnity prays that the said Benjamin Sharp may be Committed and he discharged from the Bail peice afd Whereupon the Said Benjamin Sharp is by the Court here Committed to the prison of the Sheriffe of the County aforesaid there to remain untill &.a and the said Joshua Tull of and from the Bail peice afd is discharged thereupon day is given to the afd Benjamin Sharpe by the Court here ^in Custody as afd^ untill next Court to be held at dividing Creek the third Tuesday of August then next following and the Same day is given to the afd Littleton here also &c Att which day here Came againe as well the af.d Littleton Townsend ^by his attorney af.d^ as the af.d Benjamin Sharp in Custody as af.d by Robert Jenckins Henry his attorney and ^whereupon the said Benjamin^ defends the force and Injury when &.a and says that he was not Indebted to the af.d Job Sherry in his life time the af.d sum of eighty pounds and ten shillings or any penny thereof in the form in which the af.d plantiffe above against him hath declared and of this he puts himself upon the Countrey &a And Whereupon the af.d Benjamin Sharp Relinquesth his verification af.d by him above pretended and saith that he Cannot deny the action af.d of the af.d Littleton Townsend nor but that the writing Obligatory af.d is the deed of him the said Benjamin nor but that he detaineth from the same Littleton the af.d eighty pounds ten Shillings Currt money in manner and form as the af.d Littleton above against him hath declared Whereupon |
