175 Justices his Lordships writt of Certiorari the Tenor whereof Followeth in these words Maryland ss.t Charles absolute Lord and propry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c To the Justices and Clerk of Somerset County Greeting we being Willing for Certain Causes to be Certified of the Record and Proceedings of a Certain action before you depending between John Tunstall and Francis Allen of a plea of trespass upon the Case We Command you that the record and proceedings in the Action af.d with all things thereunto relating as far as before you it remains by whatsoever name the parties in the same ^are^ distinguished to our Justices of our provincial Court to be held at annapolis the second Tuesday of Aprill next under your hands and Seals you send together with this writ that our Same Justices my further do therein that which of right they see ought to be done Wittness Levin Gale Esq.r Chief Justice of our said Court the 22.d Day of October in the 27.th Year of our Dominion &a Annoq Dom 1741 Issued Oct.r 27 1741 Wm Cumming WGhiselin Clk allowed p Robert Gordon Which being Read and heard the said writt together with the Record and plea in the said Writt mentioned we send to appear by the proceeding abovesaid In testimony &ai
such Case made and provided &c Whereupon the said Thomas Walker with Thomas Gillisse and Henry Ballard of Somerset County Gent his Securitys all present herein Court in their proper persons Acknowledged themselves to be Indebted unto his Lordship the right Honrble the Lord proprietary of Maryland in the full and Just sum of Five pounds Curr.t money of said province of their bodys goods or Chattles Lands or tenements Severally to be made and Levied to the use of his said Lordship his heirs and Successors if it happen that the said Thomas Walker doe not pay and satisfie unto the sheriffe of the County af.d for the time being Fifty shillings Currant money of the province af.d Yearly and every year he shall keep such ordinary or house of Entertainment as af.d &c Likewise the same Thomas Walker with the af.d Thomas Gilliss and Henry Ballard his Securitys af.d all present here in Court in their proper persons as af.d Acknowledged themselves Indebted unto his said Lordship the Lord proprietary in forty pounds Currant money of Maryland of their bodys goods or Chattles Lands or tenements severally to be made and Levied to the use of his said Lordship his heirs and Successors if it happen that the said Thomas Walker do not keep good rules and orders and do suffer Idle loose and disorderly persons to tipple game or Commit disorders or other Irregularities in his ordinary or house of Enter tainment during the time that he shall keep the same Contrary to the true Intent and meaning of the Act of Assembly in such Case made and provided &c
granted he giving Security to Comply with the Act of Assembly in such Case made and provided &c Whereupon |
