day and year Last af.d at the County af.d at the especiall Request of the said Edmund had
delivered to the said Edmond his the said Duncans proven account against the said Godfrey for the
sum of thirty six pounds eighteen shillings and nine pence af.d together with a receipt thereon
Signed by the said Duncan acknowledging the satisfaction thereof that the said Edmond might
have an allowance thereof made to him by the Commissary af.d in his accounting af.d he the said
Edmond upon himself did assume and to the said Duncan then and there faithfully promise
to pay to the said Duncan the said ^sum^ Last named being ballance due to him on the said account
when he should be thereto Required by the said Duncan  Nevertheless the said Edmond his promise
af.d in form af.d made not Regarding but minding and fraudulently intending the said
Duncan in that part Craftilly and Subtilly to deceive and defraud the said Ballance and
sum Last named to the said Duncan hath not paid or him for the same in any sort hitherto
Contented but that to doe altogether hath refused and still doth refuse altho' thereto afterwards
(to wit) the day and year Last af.d at the County af.d and often since that time by the said
Duncan Required  Whereupon he says he is damnifyed thirty pounds Currt money of maryland
and thereof he brings suit &.a                                                   Pledges &a  J Doe & R Roe

                        And the af.d Edmond Crapper J.r Adm.r as af.d by his attorney af.d Comes and defends
the force and Injury when &.a and prays Leave thereof to Imparle here untill next Court to be
held at dividing Creek in and for the County af.d the third tuesday of June then next Following and he
hath it and the same day is given to the af.d Duncan here also &.a

                   Att which day here Came againe as well the af.d Duncan Murray as the af.d Edmond
Crapper Jun.r Adm.r as af.d by their attornys af.d and Whereupon the same Edmond Crapper J.r
Adm.r as af.d as before defends the force and Injury when &.a and by protestation saith that the
decleration of the same Duncan and the matter therein Contained are not sufficient neither by
the Law Land is he the said Edmond thereto in any sort held to answer  Nevertheless for plea
the same Edmond saith that he did not assume in manner and form as the said Plantiff above
against him hath Complained and of this he puts himself upon the Country &.a

       And hereupon the said Duncan Murray prays Leave thereof to Imparle here untill
Next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then
next Following and he hath it and the same day is given to the af.d Edmond Crapper J.r Adm.r as fo
