                   Att which day here Came againe as well the af.d Duncan Murray as the af.d Edmond
Crapper J.r Adm.r as af.d by their attorneys af.d and Whereupon the af.d Edmond Crapper Adm.r
as af.d Prays that the af.d Duncan Murray to the plea of him the said Edmond may Reply but
the same Duncan altho' Solemnly Called Cometh not nor to the plea of the same Edmond Replyeth
not nor is his writt af.d against the Edmond further prosecuted

                      Therefore it is Considered by the Court here that the af.d Duncan Murray take
nothing by his writt af.d but that he and his pledges of prosecuting (to witt) John Doe and Richard
Roe are in mercy and that the af.d Edmond ^Crapper Jr^ Administrator as af.d goe thereof without day  And Also
It is Considered that the af.d Edmond Crapper Jun.r Administrator as af.d Recover against the af.d
320    Duncan Murray                                                    Pounds of tobacco for his Costs and Charges
by him about his defence af.d in that part Sustained by the Court now here adjudged according to
the form of the statute in such Case Lately made and provided and that the same Edmond Crapper J.r
Administrator as af.d have thereof Execution &.a

          Command was given to the Sheriffe of Somerset County that he should
Take Saward Tomlinson Late of Somerset County planter otherwise Called
                               Seward Tomlinson of Somerset County in the province of maryland Planter if he
should be found in his bailywick and him should safe keep so that he might have his body before
the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday
of March Anno Dom one thousand seven hundred and forty to answer unto Joseph Houston of a plea
that he render unto him Forty pounds Currt money of maryland in silver or whole Gold or eighty pounds
paper money of maryland which to him he owes and unjustly detains &.a and the same day is given to
the af.d Joseph here also &.a

                   Att which day here Came the af.d Joseph Houston by George Douglas his attorny and the
Sheriffe to witt John Handy Gent now here Returned that he had taken the af.d Seward Tomlinson whose
body hereat this day he had Ready to answer the af.d Joseph Houston of the af.d Plea as to him it was
Commanded
                                                 Whereupon Came hereinto the af.d Seward Tomlinson in his proper person
and thereupon the said Seward Tomlinson at the prayer of the af.d Joseph Houston is adjudged to give
