162 William Arbuckle his attorny and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Jonathan Shockly whose body hereat this day he had Ready to answer the af.d Francis Tate of the af.d plea as to him it was Commanded Whereupon the said Jonathan Shockly at the prayer of the af.d Francis Tate is adjudged to give speciall bail to the action af.d Thereupon Came hereinto Court A Certain James Longo of Somerset County planter in his proper person and undertook for the said Jonathan Shockly (Likewise the said Jonathan Shockly present herein Court in his proper person and assumed upon himself) that If it should happen that Judgment in the plea af.d should be Rendred for the same Francis Tate against the said Jonathan Shockly or that he the said Jonathan should be therein Convict that then the said Jonathan should pay and Satisfie unto the said Francis Tate the Judgment of the Court thereupon or render his body in execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the said James Longo will do the same for him &.a Whereupon the af.d Jonathan Shockly puts in his place George Douglas Gent attorney at Law against the af.d Francis Tate of the af.d plea And thereupon at the Request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of March then next Following in the same state as at present saveing to the parties af.d &.a Att which day here Came againe as well the af.d Francis Tate as the af.d Jonathan Shockly by their attorneys af.d and hereupon the said Francis Tate declared against the af.d Jonathan Shockly in the plea af.d in form Following Somerset ss Jonathan Shockly Late of Somerset County planter was attached to answer unto Francis Tate of a plea of trespass upon the Case &.a And Whereupon the same Francis by William Arbuckle his attorny Complains that whereas the said Jonathan the twelfth day of may Anno Dom Seventeen hundred and forty at the County af.d was Indebted to the same Francis in the sum of seven pounds Nine Shillings and two pence Currt money of maryland for Sundry things properly Chargeable in account as by an account thereof hereto annexed may appear and so being thereof Indebted |
