    August Court                  1741            161

Sommerset Memorand.m   That on the 13.th day of December Ann.o Dom 1740 Came James Johnson and John Peterson before
us two of his Lordships Justices of the peace for Sommerset County and made Oath on the Holy Evangelist of almighty
God that the within Account against Jarvis Ballard as it stands stated is Just and true and that the severall Articles were
delivered by them Either together or by one of them from the other Except ^the^ two last articles of said Account and that they never
received part or percell thereof more then Creditt is Given for                Sworn before                       Geo Dashiell

                And the af.d Jarvis Ballard by his Attorney af.d Comes and defends the force and Injury when &c  and prayeth leave
thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of June then
next Following and he hath it and the same day is given to the af.d James here also &c

                   Att which day here Came again as well the af.d James Johnson as the af.d Jarvis Ballard by their Attorneys af.d
And Whereupon the parties aforesaid by their said attorneys Submitted their dispute in this action to the arbitrament &
final determination of George Gale and Samuel Wilson of Sommerset County Gentlemen and it is agreed by and between
the parties aforesaid that the aforesaid Arbitrators Return their arbitrament in Writing under their hands and seals to the Justices
of his Lordships County Court of Somerset to be held at dividing Creek in and for the County afd the third Tuesday of
August then next following that the same Justices may proceed thereon to Judgm.t against either of the parties afd as if
the Cause were determined by the Court   And it is further agreed by their parties afd by their attorneys aforesaid
that that Submission aforesaid be made a rule of this Court  Therefore it is Ordered that the Submission aforesaid in
manner and form afd made according to the form and Effect of the Statute in that Case Lately made and provided
be Entered and made a rule of this Court on the motion of the parties afd by their attorneys afd and the same day
is given to the parties afd here &a

                            Att Which day here Came againe the parties aforesaid by their attorneys aforesaid and hereupon
George Gale and Samuel Wilson the Gentlemen mentioned in the above rule of Submission Likewise Came and
made Return of their arbitrament in the premisses afd between the parties aforesaid in manner following   Pursuant
to the Submission of James Johnson plft and Jarvis Ballard of to us Submitted we doe award that the afd Jarvis
Ballard pay to the said James Twelve pounds of tobacco and five pounds ten Shillings Currant money of
Maryland and that the said James Johnson pay to the said Jarvis Ballard his full Costs in the Suit Given under
209   Our hands this 26.th day of August 1741                                             Geo Gale

    Command was given to the Sheriffe of Sommerset County that he Should Take Jonathan
Shockley late of Somerset County planter if he should be found in his bailywick and him should
safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset
to be held at deviding Creek the third tuesday of November Anno Dom one thousand seven hundred
and forty to answer unto Francis Tate of a plea of trespass upon the Case &.a and the same day
is given to the af.d Francis here &.a               Att which day here Came the af.d Francis Tate by
