148 Evans to the Grand Jury &c Whereupon Came here into Court the af.d Joseph Lewis in his proper person and undertook for the said Rachel Barnet and Acknowledged himself Indebted unto his said Lordship the Lord proprietary of Maryland in twenty pounds Curr money of Same province of his body goods or Chattles Lands or tenements to the use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said Rachel Barnet do not make her personall appearance before his said Lordships Justices at the next Court to be held at dividing Creek the the third Tuesday of November then next Following and doe not then and there give Such Evidence as she shall know on behalfe of his said Lordship against the af.d Gammage Evans and that she do depart the same Court without Leave &c
presented that Francis Tate of Stepney parish for Selling of Liquor without Lycence which he has done for some time and in the month of February last did sell to John Shockley one q.t of Rum and did demand and Receive for the Same one bushell ^& a halfe^ of Indian Corn By which it was Commanded the Sheriffe of the County aforesaid that he Should take the said Francis Tate if &.a to answer &.a And afterwards to witt the Same day and Year abovsaid before his said Lordships Justices at a Court then held at dividing Creek in and for the County aforesaid Came the said Francis Tate in his proper person and thereupon the said Francis Tate is Ordered by the Court here to give Security for his appearance at the next Court to be held at dividing Creek in and for the County afd the third Tuesday of June then next following to answer unto the presentment aforesaid &.a but for want thereof the said Francis Tate is Committed into the Custody of the Sheriffe of the County afd there to remain untill he shall be from thence be delivered by due Course of Law &c Att which said third Tuesday of June Ann Dom One thousand seven hundred and forty One at a Court then held at dividing Creek by his said Lordships Justices Came the afd Francis Tate in his proper person in Custody of the Sheriffe of the County aforesaid in whose Custody for the Cause aforesaid was Committed and being by the said sheriffe Ledd to the Barr is thereupon Instantly Ordered to give security for his appearance at the next Court to be held at dividing Creek in and for the County af.d the third Tuesday of August then next Following to Answer unto the presentment af.d &c but for want thereof the said Francis Tate is Committed into the Custody of the sheriffe of the County af.d there to remain untill he ^shall^ be from thence be delivered by due Course of Law &c Att which said third Tuesday of August Anno Dom one thousand seven hundred and forty one at a Court then held at dividing Creek by his said Lordships Justices Came the af.d Francis Tate in his proper person in Custody of the sheriffe of the County af.d in whose Custody for the Cause af.d was Committed and being by the ^said^ sheriffe Ledd to the barr and had a hearing of the presentmt afd |
