the sixteenth day of the same month Anno Dom one thousand seven hundred and forty one before his said Lordships Justices the peace in the County af.d to keep assigned by the oath of twelve Jurors presented that Rachel Barnet Late of All hallows Parish in the County af.d Spinster the thirtieth day of August in the Year of Our Lord One thousand Seven hundred and forty at the parish aforesaid in the County aforesaid and within the Jurisdiction of this Court did Commit fornication with a Certain person to the Jurors afd unknown and did permitt the Same unknown person then and there to beget a bastard Child on the body of her the Same Rachell Barnet to ^the^ high displeasure of almighty God to the Evill Example of all others in Such Case Offending Contrary to the peace of the said Lord proprietary that now is his Good rule and Goverment and against the form of the Act of Assembly in Such Case lately made and provided &c Thereupon it was Commanded the sheriffe of the County af.d that he should take the said Rachel Barnet if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August one thounds seven hundred and forty one to answer unto his said Lordship of the Indictment af.d &c And now to wit at a Court held for the County af.d the third Tuesday of August being the Eighteenth day of the same month Anno Dom one thousand seven hundred and forty one before his said Lordships Justices at dividing Creek Came the af.d Rachel Barnet in her proper person and had a hearing of the Indictment af.d and saith that she Cannot deny but that she is guilty of the premisses af.d in the Indictment af.d Specefyed in manner and form as by the Indictment af.d above against her supposed and the premisses in the Indict af.d Expressly Acknowledgeth and maketh Oath that a Certain Gammage Evans is the begetter of the Child she stands Indicted Indicted for and is willing to pay her fine for the fact af.d &c Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the af.d Rachel Barnett pay unto his said Lordship the Right Honrble Charles Absolute Lord and proprietary of the province of Maryland for her fine by the Court here ^upon her^ Imposed for and by Occasion of the premisses af.d whereof in forme af.d she is Convict thirty shillings Curr.t money of Maryland and that the said Rachel Barnet be taken to satisfie his said Lordship of the fin af.d &c Whereupon the said Rachell Barnet is Ordered to give good Security for the paymt of all Fee or Fees due on the Indictment af.d to any person or persons whatsoever Thereupon a Certain Joseph Lewis of Somerset County planter present here in Court undertook for the said Rachel Barnet to pay all Fee or Fees due to any person or persons whatsoever on the Indictment af.d in Case the said Rachel Barnett doth not pay the same &c Thereupon the said Rachel Barnet is Ordered to give Security for her appearance at the next Court to be held at dividing Creek ^in & for the County af.d^ the third Tuesday of November then next Following to give Evidence on behalf of his said Lordship against the af.d Gammage Evans |
