147 person then and there to have Carnall knowledge of her body and then and there to beget a bastard Child on the body of her the same Jean Hains and to the high displeasure of Almighty God to the Evill Example of all others in such Case offending Contrary to the peace of the said Lord proprietary that now is his good rule and Goverment and against the form of the Act of Assembly in such Case lately made and provided &c Thereupon it was Commanded the sheriffe of the County af.d that he should take the said John Hains if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August one thousand seven hundred and forty one to answer unto his said Lordship of the Indictment &c And now to wit at a Court held for the County af.d the third Tuesday of August being the Eighteenth day of the same month Anno Dom one thousand seven hundred and forty one before his said Lordships Justices at dividing Creek Came the af.d Jean Hains in her proper person and had a hearing of the Indictment af.d and saith that she Cannot deny but that she is guilty of the premisses af.d in the Indictment af.d Specefyed in manner and form as by the Indictment af.d above against her supposed and the premisses in the Indictment af.d Expreslly Acknowledgeth and maketh Oath that a Certain Michael Redding is the begetter of the Child she stands Indicted for and is willing to pay her fine for the fact af.d &c Whereupon all and singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the af.d Jean Hains pay unto his said Lordship the Right Honrble Charles Absolute Lord and proprietary of the province of Maryland for her fine by the Court hereupon her Imposed for and by Occasion of the premisses af.d whereof in forme af.d she is Convict thirty shillings Cur.t money of Maryland and that the said Jean Hains be taken to satisfie his said Lordship of the fine af.d &c Wherepon the said Jean Hains is Ordered to give good Security for the payment of all Fee or Fees due on the Indictment af.d to any person or persons whatsoever Thereupon a Certain Mary Stilley of Somerset County widdow present herein Court undertook for the said Jean Hains to pay all Fee or Fees due to any person or persons whatsoever on the Indictment af.d in Case the said Jean Hains doth not pay the same &c Thereupon the said Jean Hains is Ordered to give Security for her appearance at the next Court to be held at dividing Creek in and for the County af.d the third tuesday of November then next Following to give Evidence on behalf of his said Lordship against the af.d Michaell Redding to the grant Jury &c Whereupon Came hereinto Court the af.d Mary Stilley in her proper person and undertook for the said Jean Hains and Acknowledged herself Indebted unto his said Lordship the Lord proprietary of Maryland in twenty pounds Curr.t money of said province of her body goods or Cahttles lands or tenements to the use of his said Lordship his heirs and Successors If it happen that the said Jean Hains do not make her personall appearance before his said Lordships Justices at the next Court to be held at dividing Creek the third Tuesday of November then next Following and doe not then and there give such Evidence as she shall know on behalf of his said Lordship against the af.d Michaell Redding and that she do depart the same Court without Leave &c |
