146 Premisses af.d in the Indictment aforesaid Specifyed in manner and form as by the Indictment af.d above against her Supposed and the premisses af.d in the Indictment af.d expressly acknowledgeth and maketh oath that a Certain Charles Cade is the better of the bastard Child she stands Indicted for and is willing to pay her fine for the fact af.d &.a Whereupon all and Singular the primisses being seen and by the Court here fully understood it is Considered by the Court here that the af.d Marjorum Mallard pay unto his said Lordship the Right Honourable Charles absolute Lord and Proprietary of the province of maryland for her fine by the Court hereupon her Imposed for and by occasion of the premisses af.d whereof in form af.d she is Convict thirty shillings Currt money of maryland and that the said Marjorum Mallard be taken to satisfie his said Lordship of the fine af.d &.a Whereupon the said Marjorum Mallard is ordered to give good Security for the payment of all fee or fees due on the Indictment af.d to any person or persons whatsoever Thereupon a Certain George Douglas of Somerset County Gentleman present herein Court undertook for the said Marjorum Mallard to pay all fee or fees due unto any person or persons whatsoever on the Indictment af.d in Case the said Marjorum Mallard doth not pay the same &.a Thereupon the said Marjorum Mallard is ordered to give security for her appearance at the Next Court to be held at dividing Creek in and for the County af.d the third tuesday of November then next Following to give evidence on behalf of his said Lordship against the af.d Charles Cade to the grand Jury &.a Whereupon Came hereinto Court the af.d George Douglas in his proper person and undertook for the said Marjorum Mallard and acknowledged himself Indebted unto his said Lordship the Lord proprietary of maryland in twenty pounds Currt money of said Province of his body goods or Chattles Lands or tennaments to the use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said Marjorum Mallard do not make her personall appearance before his said Lordships Justices at the next Court to be held at dividing Creek the third tuesday of November then next Following and doe not then and there give such evidence as she shall know on behalf of his said Lordship against the said Charles Cade and that she do depart the same Court without Leave &.a
the tenth day of July in the year of our Lord one thousand seven hundred and forty at the parish af.d in the County af.d and within the Jurisdiction of this Court did Commit fornication with a Certain person to the Jurors af.d unknown and did permit the Same unknown person |
