146 said Sarah Mears and acknowledged himself Indebted unto his said Lordship the Lord Proprietary of Maryland in Twenty pounds Currant money of the said Province of his body goods and Chattles Lands or Tenements to the use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said Sarah Mears do not make her personall appearance before his said Lordships Justices at the next Court to be held at dividing Creek the third Tuesday of November then next following and doe not then and there give such Evidence as she shall know on behalfe of his said Lordships against the afd Absolom Hobbs and that she do not depart the Same Court without Leave &.c And afterwards the same Joseph Standford and Sarah Mears of and from the Recognizance afd are by the Court here discharged &c
before his said Lordships Justices the peace in the County af.d to keep assigned by the oath of twelve Jurors presented that Marjoram Mallard late of all hallows Parish in the said County of Somerset Spinster the first day of October in the year of our Lord one thousand seven hundred and thirty nine at the parish af.d in the County af.d within the Jurisdiction of this Court Court did Comit Fornication with a Certain person unknown and did permit the same unknown person on her body then and there Carnal knowledge to have and a basterd Child on her body then and there to beget to the high displeasure of almighty God to the evill example of all others in such Case offending Contrary to the peace of the right Honourable the Lord Proprietary that now is his good Rule and Government and against the form of the act of assembly in such case lately made and provided Thereupon it was Commanded the sheriffe of the County af.d that he should take the said Marjoram Mallard if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August One thousand seven hundred and forty one to answer unto his said Lordship of the Indictment af.d &.a And now to witt at a Court held for the County af.d the third tuesday of August being the Eighteenth day of the same month Anno Dom one thousand seven hundred and forty one before his said Lordships Justices at dividing Creek Came the af.d Marjoram Mallard in her proper person and and had a hearing of the Indictment af.d and saith that she Cannot deny but that she is Guilty of the Premisses |
