be requested  Nevertheless the af.d John Lecatt altho' often requested the af.d Eight thousand pounds of tobacco to the same John
Henry he hath not paid but the same to him hetherto to pay altogether hath denyed and still deny whereupon the said John Henry
says that he is the worse and hath damage to the value of Eight hundred pounds of tobacco and thereof he brings suit &c

                And the af.d John Lecatt by William Arbuckle his Attorney Comes and defends the force
and Injury when &c and prayeth leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of June
then next Following and he hath it and the same day is given to the af.d John Henry here also &c

                               Att which day here Came againe the said John Henry by his Attorney af.d and prays that the af.d John Lecatt
to his declaration af.d may answer and the af.d John Lecatt altho' Solemnly Called Came not nor says nothing in barr or preclusion
of the Action af.d of the af.d John Henry by wich which the same John Henry remains thereof against the af.d John Lecatt undefended
&c
                               Therefore it is Considered that the af.d John Henry recover against the af.d John Lecatt his debt af.d and his
damages by occasion of the detention of the same debt to:                                                                                 :pounds of
tobacco to the same John Henry of his Assent by the Court here adjudged and the af.d John Lecatt in mercy &c

    Command was given to the sheriffe of Somerset County that he should take Edward
Rownd late of Somerset County Gent if he should be found in his bailywick and him should safe
keep so that he might have his body before the Justices of his Lordships County Court of
Somerset to be held at dividing Creek the third tuesday of March Anno Dom one thousand seven hundred and forty to
answer unto John Dennis Jun.r of a plea of trespass upon the Case &.c and the same day is given to the af.d John here &c

                      Att which day here Came the af.d John Dennis by George Douglas his Attorney and the sheriffe to witt John
Handy Gent now here returned that he had taken the af.d Edward Rownd whose body here at this day he had ready to answer the
af.d John Dennis of the af.d plea as to him it was Commanded

                               And hereupon the said John Dennis Complained against the af.d Edward Rownd in the plea af.d in
form Following      Somerset ss.t  Edward Rownd late of Somerset County Gent was attached to answer unto John Dennis Junr
of a plea of trespass upon the Case &c

                               And Whereupon the said John by Geo Douglas his Attorney Complains that whereas the said Edward on the
first day of Novr Anno Dom MDCCXL at the County af.d was Indebted to the said John in the quantity of fifty Seven and
a half bushells of Indian Corn one pound tenn shillings Curr.t money of maryland and seven hundred and Eighty two pounds of
tobacco for Sundry matters properly Chargeable in account as by an account thereof hereto annexed may appear and so being
thereof indebted afterwards to wit on the day and year af.d at the County af.d on Consideration thereof upon himself did assume
and to the said John then and there faithfully promise that he the said Edward the said fifty seven bushells and a half of
Indian Corn one pound ten shillings Curr.t money and seven hundred and Eighty two pounds of tobacco when he should
