135 prayeth Leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of June then next following and he hath it and the Same day is given to the aforesaid John Henry here also &c Att which day here Came againe the said John Henry by his attorney afd and prays that the aforesaid Francis to his declaration aforesaid may answer and the aforesaid Francis Tate altho' Solemnly Called Came not nor says nothing in barr or preclusion of the action aforesaid of the aforesaid John Henry by which the same John Remains thereof against the aforesaid Francis undefended &a Therefore it is Considered that the aforesaid John Henry Recover against the afd Francis Tate his debt aforesaid and his damages by Occasion of the detention of the same debt to 349 pounds of tobacco to the same John of his assent by the Court here adjudged and the aforesaid Francis in mercy &a
and forty to answer unto John Henry late sheriffe of a plea that he render unto him eight thousand pounds of good sound merchantable leaf tobacco and Cask which to him he owes and unjustly detains &c and the same day is given to the af.d John here &c Att which day here Came the af.d John Henry by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d John Lecat whose body here at this day he had ready to answer the af.d John Henry of the af.d plea as to him it was Commanded Whereupon the af.d John Lecatt puts in his place William Arbuckle Gent Attorney at Law against the af.d John Henry of the af.d plea And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek in and for the County af.d the third Tuesday of March then next Following in the same state as at present saving to the parties af.d &c Att which day here Came again the parties af.d by their Attorneys af.d and hereupon the said John Henry declared against the af.d John Lecat in the plea af.d in form Following Somerset ss.t John Lecat late of Somerset County planter otherwise Called John Lecatt of Somerset County and province of Maryland was summoned to answer unto John Henry late sheriffe of a plea that he render unto him Eight Thousand pounds of good sound merchantable leaf tobacco and Cask which to him he owes and unjustly detains &c And Whereupon the said John Henry by Robert Jenckins Henry his Attorney says that whereas the af.d John Lecatt the twenty third day of July in the year of our Lord one thousand seven hundred and forty at Somerset County af.d by his Certain writing obligatory with the seal of him the said John Lecatt sealed and here into Court brought the date of which is the same day and year did acknowledge himself to be held and firmly bound unto the said John Henry then sheriffe of the County af.d being by the name of Cap.t John Henry sher in the af.d Eight Thousand pounds of good sound merchantable leaf tobacco and Cask to be paid to the said John Henry when thereof he should be requested be |
