136 be afterwards thereto required by the said John he would faithfully pay and Content and altho' the said Edward hath not paid to the said John twenty three bushells of Indian Corn part of the said fifty seven and a half bushells of Indian Corn Nevertheless as to thirty four and a half bushells of Indian Corn residue of the said fifty seven and a half bushells of Indian Corn ^and^ as also as to the said one pound tenn shillings Curr.t money af.d and seven hundred Eighty and two pounds of tobacco af.d the said Edward his promise and ssumption af.d in form af.d made not regarding but minding and fraudulently intending the said John in that part Craftily and Subtilly to deceive and defraud the said Residue of thirty four and a half bushells of Indian Corn and the said one pounds ten shillings Curr.t money af.d and the said seven hundred and Eighty two pounds of tobacco or any part thereof to the said John hath not paid or him for the same in any sort hetherto Contented but that to doe hath altogether refused and still doth refuse altho' thereto afterwards to wit on the day and year af.d at the County af.d and often since that time by the said John required Whereupon he says he is damnifyed twenty pounds Curr.t money of maryland and thereof he brings Suit &c Pledg.s &c J Doe R Roe
Whereupon at the prayer of the af.d Joh Dennis the af.d Edward Rownd is Adjudged to give speciall bail to the acticon af.d Thereupon Came here into Court a Certain James Martin of Somerset County Gent and undertook for the said Edward Rownd (Likewise the said Edward Rownd present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for him the said John Dennis against the af.d Edward Rownd or that he the same Edward Rownd should be therein Convict that then he the same Edward Rownd should pay and satisfie unto the said John Dennis the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same James Martin will do the same for him &c And the af.d Edward Rownd in his proper person Comes and defends the force and Injury when &c and prayeth leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of June then next Following and he hath it and the same day is given to the af.d John here also &c Att which day here Came againe as well the afd John Dennis Jun.r as the afd Edward Rownd in his proper person and hereupon the said John Dennis prays that the aforesaid Edward Rownd to his declaration aforesaid may answer but the said Edward at the same day altho' Solemnly Called Came not nor nothing thereof saith in Barr or preclusion of the action aforesaid of the afd John by which the same |
