Codery his damages af.d to the af.d thirty pounds three shillings and six pence Curr.t money by the same John in form af.d Acknowledged
364    as also                                                                             pounds of tobacco for his Costs and Charges af.d to the same Levin at
his request by the Court now here Adjudged which Certain damages in the whole amounts to thirty pounds three shillings and six
pence Curr.t money and                                                                pounds of tobacco and the af.d Abraham in mercy &c

    Command was given to the sheriffe of Somerset County that he should take late ^Francis Tate^ of Somerset County
Inholder otherwise Called Francis Tate Inholder of Somerset County and province of maryland if he
should be found in his bailywick and him should safe keep so that he might have his body before the Justices
of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of Novr Anno Dom one thousand seven
hundred and forty one to answer unto John Henry late sheriffe of a plea that he render unto him the sum of eight thousand pounds
of good sound merchantable leaf tobacco and Cask which to him he owes and unjustly detains &c  and the same day is given to the af.d
John here &c
                            Att which day here Came the af.d John Henry by Robert Jenckins Henry his Attorney and the sheriffe to witt
John Handy Gent now here returned that he had taken the af.d Francis Tate whose body hereat this day he had ready to answer
the af.d John Henry of the af.d plea as to him it was Commanded

                            Whereupon the af.d Francis Tate puts in his place William Arbuckle Gent Attorney at Law against the af.d John
Henry of the af.d plea
                                           And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at
dividing Creek in and for the County af.d the third Tuesday of March then next Following in the same state as at present saving to the
parties af.d &c
                               Att which day here Came again as the parties af.d by their Attorneys af.d and hereupon the said John Henry declared
against the af.d Francis Tate in the plea af.d in form Following      Somerset ss  Francis Tate late of Somerset County Inholder otherwise
Called Francis Tate Inholder of Somerset County and province of maryland was Summoned to answer unto John Henry late sheriffe
of a plea that he render unto him the sum of eight Thousand pounds of good sound merchantable leaf tobacco and Cask which to him he
owes and unjustly detains &c

                                     And Whereupon the said John by Robert Jenckins Henry his Attorney says that whereas the af.d
Francis the twenty third day of July in the year of our Lord one thousand seven hundred and forty at Somerset County ^af.d^ by his Certain
writing obligatory with the seal of him the said Francis sealed and hereinto Court brought the date of which is the same day and
year did Acknowledge himself to be held and firmly bound unto the said John Henry then sheriffe of the County af.d being by the
name of Cap.t John Henry sher in the af.d Eight Thousand pounds of good sound merchantable leaf Tobacco and Cask to be paid
to the same John when thereof he should be requested  Nevertheless the af.d Francis altho' often requested the af.d eight thousand
pounds of tobacco to the af.d John he hath not as yett paid but the same to him hetherto to pay hath altogether denyed and
still doth deny  Whereupon the same John says ^that^ he is worse and hath damage to the value of Eight hundred pounds of
tobacco and thereof he brings Suit &c                                                                                              Pledg.s &c J: Doe  R: Roe

       And the aforesaid francis Tate by William Arbuckle his attorney Cometh and defendeth the force and Injury when &c and
