129 Commanded and further the same sheriffe Returned that he had Served the af.d Francis Tate with a Copy of the foregoing decleration according to act of assembly in such case made and provided &.a Whereupon Came hereinto Court a Certain John Caldwell of Somerset County Gent in his proper person and undertook for the said Francis Tate that if it should happen that Judgment in the plea af.d should be rendred for the same James Longo against the af.d Francis Tate or that he the said Francis Tate should be therein Convict that then he the same Francis Tate should pay and satisfie unto the said James Longo the Judgment of the Court thereupon or render his body in execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same John Caldwell will do the same for him &.a And the aforesaid Francis Tate by William Arbuckle his attorney Cometh and defendeth the force and Injury when &.a And Thereupon the parties aforesaid by their attorneys present here in Court Submitted the dispute in this action to the arbitrament and final determination of George Dashiell Thomas Gillisse and Mitchell Dashiell of Somerset County Gentlemen or any two of them and it is agreed by and Between the parties aforesaid that the aforesaid Arbitrators or any two of them Return their arbitrament in writing under their hands and seals to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of June then next Following that the same Justices may proceed thereon to Judgment against Either of the parties aforesaid as if the Cause were determined by the Same Court And it is further agreed by and Between the parties aforesaid that that Submission aforesaid be made a rule of this Court therefore it is Ordered that the submission aforesaid in manner and form aforesaid made according to the form and Effect of the statute in that Case Lately made and provided be entered and made a rule of this Court on the motion of the parties afd Att which day here Came againe the parties aforesaid ^by their attorneys aforesaid^ and hereupon George Dashiell and Thomas Gillisse two of the Gentlemen mentioned in the above Submission ^Likewise Came^ and Returned that Arbitrament in the premisses aforesaid Between the parties aforesaid in writing from under their hands and seals in manner following We the Subscribers pursuant to a Submission made by James Longo and Francis Tate to to the Subscribers to determine an action in Somerset County Court depending between the said parties haveing heard and duly Considered on the evidence and Allegations of the said parties doe award that the said Francis pay to the said James Longo the sum of thirteen pounds nine shillings and eleven pence Currt money of maryland and the Costs of the said action witness our hands and seals this 16.th day of June Anno Dom 1741 Geo C Dashiell (seal) Tho.s Gilliss (seal) Which award being Read and heard and by the Court here fully understood It is Considered by the Court here that the af.d James Longo Recover against the Francis Tate the af.d thirteen pounds nine Shillings and eleven pence Currt money of maryland his damages af.d by the arbitrators 557 af.d in form af.d found as also Pounds of tobacco for his Costs and Charges af.d to the same James by the Court now here of his assent adjudged and the af.d Francis Tate in Mercy &.a |
