                 June Court                             1741                            128

    things properly Chargeable in account as by account thereof hereto annexed may appear and so being
thereof Indebted Afterwards to wit the day and year last af.d at the County af.d on Consideration thereof
on himself did assume and to the said James then and thereof he fully promise that he the said
Francis the said Seven pounds five Shillings and Eleven pence when he should be afterwards thereto
Required he would faithfully pay and Content  Nevertheless the said Francis his severall promisses af.d
in form af.d made not regarding but minding and fraudulently intending the said James in that
part to deceive and defraud the said pork according to the tenor of that note hath not paid or the
said money in the Last promise mentioned to the said James hath not paid or him for the same in any
sort hetherto Contented but that to doe altogether hath refused and still doth refuse altho' therto
Afterwards to wit the say and year Last af.d at the County af.d and often since that time by the said
James Required Whereupon the said James says he is damnifyed thirty pounds Currt money af.d
and thereof he brings suit &.a                                                      Pledges &.a J Doe and R Roe

Evangelist of almighty God that the above
account is Just and true and that he hath not
directly or Indirectly received the same or any
part thereof or any security or satisfaction
for the same or any part thereof to the best of
his knowledge              Henry Ballard

     A Copy of the foregoing deleration was
made and sent to be served on the Deft with
the writt in the plea af.d

           Att which day here Came the af.d James
Longo by his attorney af.d and the sheriffe
to witt John Handy Gent now here Returned
that he had taken the af.d Francis Tate whose
body hereat this day he had ready to answer the
af.d James of the af.d Plea as to him it was
