128 him by Occasion of the premisses in that part Sustained the same Peter Taylor saith that Acknowledgeth that the af.d Elias hath Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to thirteen pounds six shillings and eight pence and not more and because the af.d Elias denys not this but the same allegation Granted to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d Elias Evans recover against the af.d Peter Taylor his damages af.d to the af.d thirteen pounds six shillings and Eight pence ^Currant Money of Maryland^ by the same Peter in form 284 af.d Acknowledged as also pounds of tobacco for his Costs and Charges af.d to the same Elias at his request by the Court now here of the assent of the parties af.d Adjudged which Certain damages in the whole Amounts to 284 thirteen pounds six Shillings and eight pence and: pounds of tobacco with Stay of Execution untill monday the day before August Court then next Following and the afd deft in mercy &c
March Anno Dom one thousand seven hundred and forty to answer unto John Longo of a plea of trespass upon the Case &.a and the same day is given to the af.d James here &.a And hereupon the said James Longo declared against the af.d Francis Tate in the plea af.d in form Following Somerset ss Francis Tate late of Somerset County Inholder was attached to answer unto James Longo of a plea of trespass upon the Case &.a And Whereupon the said James by George Douglas his attorney Complains that whereas the said Francis on the xxiij day of June Anno Dom MDCCXL at the County af.d did make his Certain note and writing Called a promissary note and the said note with the proper name and hand writing of the said Francis subscribed to the said James Longo then and there did deliver by which note the said Francis did promise to pay to the said James seven hundred pounds of pork on the tenth day of January then net Following the making of the said note by means whereof and by force of the statute in that case lately made and provided the said Francis became Chargeable to pay to the said James the said Quantity of pork according to the tenor of that note and so being thereof Chargeable Afterwards to wit the day and year last af.d at the County af.d on Consideration thereof promised to pay to the said James the said quantity of Pork according to the tenor of that note and whereas the said Francis Afterwards to wit on the xviij day of August Anno Dom MDCCXL at the County af.d was Indebted to the said James in the sum of ^Seven pounds^ five five shillings and Eleven pence Currt money of maryland for sundry matters and things |
