127 first day of November Anno Dom Seventeen hundred and forty at Somerset County af.d within the Jur of this Court was Indebted unto the said Elias in seventeen pounds tenn shillings Current money of Maryland for Sundrys properly Chargeable in account as by account thereof hereunto annexed may in Court appear and being so thereof Indebted the said Peter in Consideration thereof the day and year af.d at the County af.d upon himself did assume and to the said Elias then and there did faithfully promise that he the said Peter the af.d Seventeen pounds tenn shillings to the said Elias when he should be afterwards thereunto requested he would well and faithfully pay and Content and altho' the said Peter Four pounds three shillings and Four pence pcell of the af.d Seventeen pounds tenn shillings to the said Elias he hath paid and satisfied yett as to thirteen pounds Six shillings and Eight pence residue of of the af.d Seventeen pounds tenn shillings the said Peter his promise and assumption af.d in forme af.d made nothing regarding but plotting and fraudulently intending the said Elias in that part Craftily and Subtilly to deceive and defraud the af.d thirteen pounds Six shillings and Eight pence to the said Elias he hath not paid or Contented altho' the same to do the af.d Peter by the said Elias on the ^af.d^ first day of November in the year af.d and often afterwards at the County af.d he was thereunto requested but the same to him hitherto to pay or Content hath refused and still doth refuse and deny Whereupon the said Elias saith he is worse and hath damage to the value of twenty six pounds Curr.t money of Maryland af.d and thereupon he brings Suit &a Pledg.s &.c J: Doe R: Roe
Febry the 28: 1740 Then Came before me one of his Lordships Justices the peace Elias Evans and made oath on the holy avangelist of Almighty God that the above Acc.t is Just and true and that he never received any part or percell satisfaction or Security more then Credit is Given for Sworn before me the day and year above written Jam.s Martin Whereupon at the prayer of the af.d Elias Evans the af.d Peter Taylor is Adjudged to give speciall bail to the action af.d Thereupon Came hereinto Court a Certain William Fleming late of Somerset County planter and undertook for the said Peter Taylor (Likewise the said Peter Taylor present here in Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same Elias Evans against the af.d Peter Taylor or that he the same Peter Taylor should be therein Convict that then he the same Peter Taylor should pay and satisfie unto the said Elias Evans the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same William Fleming will do the same for him &c And the af.d Peter Taylor by George Douglas his Attorney Comes and defends the force and Injury when &c and prayeth leave thereof to Imparle here untill next Court to be held at dividing Creek the third tuesday of June then next Following and he hath it and the same day is given to the af.d Elias here also &c Att which day here Came again as well the af.d Elias Evans of the af.d Peter Taylor by their Attorneys af.d And Whereupon the said Peter saith that he Cannot deny the Action af.d of the af.d Elias Evans nor but that he did assume upon himself in manner and form as the af.d Elias Evans above against him hath Complained and as to the damage of the same Elias by him |
