127 the said John should pay the said sum to the said Archibald in full of all accounts between the said partys before the submission af.d and this he is ready to verife Whereupon he prays Judgment if the said John his action af.d against him to have and maintain ought And the said John saith that he by any thing by the said Archibald above in his plea alledged from haveing his action af.d against him the said Archibald to be precluded ought not because he saith that he the said John never account with him the said Archibald in manner and form as the said Archibald above in pleading hath alledged for all sums of money due from the said archibald to the said John nor did the said John at the day in the said plea mentioned nor at any other time submitt all matters of Account which he had against the said Archibald to James Martin Gent in the said Plea mentioned in manner and form as the said Archibald above in his plea af.d hath Alledged and this he prays may be Inquired of by the Country &.a And afterwards the said John Wildman by his attorney af.d the same day and year Last af.d mentioned then and there his Writt af.d against the af.d Archibald M.cc Neal did not prosecute with Effect but Voluntary Suffered his suit to be discontinued Therefore afterwards (to witt) the same day by discretion of the Justices here were 282 Adjudged the same Archibald M.ccNeal Pounds of tobacco for his Costs and Charges by him about his defence in this part Sustained according to the form of the statute in such Case lately made and provided and the af.d John Wildman in mercy and the af.d Archibald M.ccNeal have thereof Execution &.a
upon the Case &c and the same day is given to the af.d Elias here &c Att which day here Came the af.d Elias Evans by Francis Allen his attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Peter Taylor whose body here at this day he had ready to answer the af.d Elias Evans of the af.d plea as to him it was Commanded And hereupon the said Elias Evans declared against the af.d Peter Taylor in the plea af.d in form Following Somerset ss Peter Taylor late of Somerset County planter was Attached to answer unto Elias Evans of a plea of trespass upon the Case &c And Whereupon the said Elias by Francis Allen his attorney Complains that whereas the said Peter the first |
