the Case &c and the same day is given to the af.d Henry here &c Att which day here Came the af.d Henry Lowes by William Arbuckle his Attorney and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d Francis Tate whose body here at this day he had ready to answer the af.d Henry Lowes of the af.d plea as to him it was Commanded Whereupon the said Francis Tate at the prayer of the aforesaid Henry Lows is adjudged to give Special bail to the action aforesaid Thereupon Came hereinto Court a Certain Henry Reynolds Late of Somerset County Bricklayer in his proper person and undertook for the aforesaid Francis Tate (Likewise the said Francis Tate present here in Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea aforesaid should be rendered for the Same Henry Lowes against the aforesaid Francis Tate or that he the said Francis Tate should be therein Convict that then he the same Francis Tate should pay and satisfie unto the said Henry Lowes the Judgment of the Court thereupon or Render his body in Execution of such Judgment to the prison of the Sheriffe of the County aforesaid in Satisfaction thereof or that he the same Henry Reynolds will doe the same for him Whereupon the aforesaid Francis Tate puts in his plea Francis Allen Gentleman Attorney at Law against the aforesaid Henry Lowes of the aforesaid plea And thereupon at the Request of the parties aforesaid day is to them now here given untill next Court to be held at dividing Creek the third Tuesday of August then next Following in the same State as at present saving to the parties aforesaid Att which day here Came againe as well the aforesaid Henry Lowes as the aforesaid Francis Tate by their attorneys aforesaid and hereupon the said Henry Lowes Complained against the aforesaid Francis Tate in the plea aforesaid in form following Somerset ss Francis Tate late of Sommerset County planter was attached to answer unto Henry Lowes of a plea of trespass upon the Case &a And whereupon the same Henry Lowes by Robert Jenckins Henry his attorney Complaines |
