Complains that whereas the af.d Francis the  twenty fourth day of may in the year of our Lord one thousand seven hundred
thirty and Eight at Somerset County af.d was Indebted to the same Henry Lowes in the sum of four pounds Eleven shillings one
penny and the half of one penny Curr.t money of Maryland for divers goods and merchandizes by the af.d Francis of the same
Henry Lowes before that time bought had and received (as by an Account thereof hereinto Court brought may appear) and
so thereof Indebted being the af.d Francis afterwards (to witt) the same day and year af.d at Somerset County af.d in
Consideration thereof upon himself did assume and to the same Henry Lowes then and there faithfully promise that
he the said Francis the af.d four pounds Eleven shillings and one penny half penny to the same Henry Lowes when
thereof he should be requested well and faithfully would pay and Content  Nevertheless the af.d Francis his promise
and assumption aforesaid in form aforesaid made not regarding but minding and fraudulently intending the same Henry
Lowes in this part Craftily and Subtilly to deceive and defraud the af.d Four pounds Eleven shillings and one penny half
penny or any penny thereof unto the same Henry Lowes he hath not paid or in any sort hetherto Contented (altho' the same
to do the af.d Francis afterwards (to witt) the same day and year above mentioned and often since that time at Somerset
County af.d by the same Henry Lowes was requested)  Whereupon the same Henry says he is worse and hath damage to the
value of ten pounds Curr.t money of the province af.d and thereupon he brings Suit &c         Pledg.s &.c J: Doe & R: Roe

                              Came Henry Lowes before me one of his
Lordships Justices of the peace for Somerset County and made
oath on the holy Evangelis of Almighty God that the within
Account against Francis Tate is Just and true and that he
not directly or Indirectly received to his Knowledge any
part or percell thereof or any Security or Satisfaction
for the same             Sworn before     Geo Dashiell
                                     Errors Excepted p
                      29.th aprill 1740                  Henry Lowes

And the aforesaid Francis Tate by his attorney Comes and defends the force and Injury when &.a and prayeth
Leave thereof to Imparle hereuntill next Court to be held at dividing Creek the third Tuesday of November
then next Following and he hath it and the Same day is given to the aforesaid Henry here also &c

                                  Att which day here Came again as well the aforesaid Henry Lowes as the af.d Francis Tate by their
attorneys af.d  And Whereupon the said Francis Tate prays further leave thereof to Imparle here untill next Court to be held
at dividing Creek the third Tuesday of March then next Following and he hath it and the same day is given to the aforesaid Henry
here also &c
                            Att which day here Came again as well the af.d Henry Lowes as the af.d Francis Tate by their attorneys
af.d and Whereupon the said Francis Tate as before defends the force and Injury when &c and saith that he did not assume
upon himself in manner and form as the said Henry above against him hath Complained and of this he puts himself upon
the Country &c      and the af.d Henry in like manner                        Therefore it is Commanded the Sheriffe of
Somerset County that he should Cause to Come before the Justices of his Lordships County Court of Somerset to be
