And Whereupon the same James by William Arbuckle his Attorney saith that whereas the af.d John on the twenty Seveventh day of march seventeen hundred and thirty nine at Somerset County af.d by his Certain note writing obligatory which the same James with the seal of the John hereinto Court brings whose date is the day and year af.d acknowledged himself to be held and firmly bound unto the same Stephen in the af.d sum of forty pounds Curr.t money to be paid to the same James when he should be thereto afterwards required Nevertheless the af.d John (altho' often required) the af.d forty pounds to the same James hath not paid but the same to pay hath hitherto altogether refused and still doth refuse to the damage of the same James Forty pounds Curr.t money of Maryland and thereof he brings Suit &c Pledg.s &a J: Doe R: Roe And the af.d John Eshom by George Douglas his attorney Comes and defends the force and Injury when &c and saith that he Cannot denny the Action af.d of the af.d James Stephen Bredell nor but that the writing obligatory af.d is the deed of the same John nor but that he oweth the same James Stephen the af.d Forty pounds Curr.t money of Maryland in manner & form as the af.d James Stephen above against him hath declared Therefore it is Considered that the af.d James Stephen Bredell recover against the af.d John Easom his 272 debt af.d and his damages by Occasion of the detaining of the same debt to pounds of tobacco to the same James Stephen of his Assent by the Court here Adjudged and the af.d John in mercy &c
And Whereupon the same Alexander by George Douglas his attorney saith that whereas the said Dennis the ninth day of August Seventeen hundred and forty by his Certain writing Obligatory which the same Alexander sealed with the Seal of the said Dennis hereinto Court brings whose date is the day and year af.d acknowledged himself to be held and firmly bound unto the said Alexander in the af.d sum of fifty pounds sterling money to be paid to the said Alexander when he should be thereto afterwards required Nevertheless the said Dennis (altho' often Required the af.d sum of fifty pounds sterling to the same Alexander hath not paid but the same to pay hath hitherto altogether refused and still doth refuse Whereupon the same Alexander saith he is damnified and damage hath to the value of fifty pounds Sterling and thereof he brings suit &.a Pledges &.a J: Doe and R: Roe And the af.d Dennis Hudson by William Arbuckle his attorny Comes and defends the force and Injury when &.a and saith that he Cannot deny the action af.d of the af.d Alexander Buncle nor but that the writing obligatory af.d is the deed of the same Dennis nor but that he oweth the |
