In obedience to the above warrant was Issued the Following Attachment against the goods and Chattles of the af.d John Evans
according to Act of Assembly in such Case made and provided &c

       Somerset ss   Charles Absolute Lord and proprietary of the province of Maryland and Avalon Lord Baron of Baltemore &c  To
the sheriffe of Somerset County Greeting we Command you that you Attach any the goods Chattles rights or Credits of John Evans late
of Somerset County planter if they shall be found in your bailywick to the value of thirteen hundred pounds of tobacco and when you
have the same so Attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our
County Court of Somerset to be held at dividing Creek the third tuesday of June Next then and there to be Condemned According to Act of
Assembly to and for the use of a Certain Nehemiah King of Somerset County Gent unless the said John Evans by himselfe or his Attorney
shall appear and and answer unto the said Nehemiah King in a plea of trespass upon the Case &.c  According to Law and that ^by^ good &
lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same Attachment that he
she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have ^why^ the same
Goods Chattles rights or Credits so Attached in his her or their hands ought not to be Condemned and Execution thereof had and made
According to Act of Assembly in such Case made and provided if to him her or them it shall seem meet & how you shall Execute this
Writt that you make known unto our said Justices at the day and place af.d and have you then and there this writt  Wittness
John Scott Gent one of our Justices of our said Court the twenty third day of March Anno Dom one thousand seven hundred & Forty

               Att which day here Came the af.d Nehemiah King in his proper persona nd the sheriffe to witt John Handy Gent now here
returned the af.d writt thereof endorsed in these words Following

       By vertue of the within writt to me directed to the Justices within mentioned I hereby Certifie that I have attached as the goods
and Chattles of the within named John Evans in the hands of Sarah Roe S.r to the value of thirteen hundred pounds of tobacco and in
the hands of Sarah Roe Jun.r thirteen hundred pounds of tobacco and I further Certifie that I have made known unto the said
Sarah Roe Sen.r and Sarah Roe Jun.r before John Windsor and George Irving good and lawfull men of my bailywick that they
be and appear at the day and place within Contained as by the within writt I am Commanded to shew Cause &c
                                                                                                                   so answers John Handy sheriffe

       And the aforesaid Sarah Roe Jun.r Garnishe of the aforesaid John Evans in her proper person appears
and saith that she Cannot deny but that She hath of the goods and Chattells of the aforesaid John Evans in her hands to
Five hundred and Six pounds of tobacco and One hundred and Sixteen pounds of unbroak Flax and not more and the said
Sarah Roe Jun.r says that she Cannot deny but that the aforesaid five hundred and Six pounds of tob.o and One hundred and
Sixteen pounds of unbroak Flax Ought to be Condemned in her hands for the Use of the said Nehemiah King as the goods and
Chattles of the aforesaid John Evans which the said Nehemiah King doth not gainsay

                             Whereupon the Court here at the prayer of the aforesaid Nehemiah King Valued the aforesaid
One hundred and sixteen pounds of unbroak Flax so as aforesaid Confessed by the aforesaid Sarah Roe Garnishee
as aforesaid to Ten pounds of tobacco and not more

                   Whereupon the said Nehemiah King prays that upon giveing Security according to act of
Assembly in such Case made and provided the aforesaid Five hundred and Six pounds of tobacco and One hundred
and sixteen pounds of unbroak Flax of the Value of ten pounds of tobacco so as aforesaid Confessed by the aforesaid
Sarah Roe Jun.r Garnishe as aforesaid may be Condemned in the hands of the said Sarah Roe Jun.r as of the goods and
