111 Chattles of the said John Evans towards Satisfying unto the said Nehemiah King his damages and all Costs and Charges accrewing by means of the attachment aforesaid Thereupon George Douglas of Somerset County Gentleman present herein Court in his proper person undertook for the said Nehemiah King according to act of assembly in such Case made and provided that In Case the said John Evans do at any time within a year and a day appear and make all or any part of the said Nehemiah Kings Claim against him appear to be satisfied or have been undue before the Laying of this attachment that then the said Nehemiah King shall make Restitution unto the said John Evans of all or such part ^thereof^ as the said John shall make appear to be undue &.a or that he the said George Douglas will do it for him &a Therefore it is Considered by the Court here that the aforesaid Five hundred and Six pounds of tobacco and One hundred and Sixteen pounds of unbroak Flax of the value of ten pounds of tobacco so as afd acknowledged by the aforesaid Sarah Roe J.r be Condemned in the hands of the said Sarah Roe J.r as of the goods and Chattles of the aforesaid John Evans towards Satisfying unto the said Nehemiah King his damages aforesaid and all Costs and Charges accrewing by means of the attachment aforesaid and that the said Nehemiah have thereof Execution &c Whereupon the aforesaid Sarah Roe Sen.r an Other of the Garnishees of the afd John Evans discharged by the afd Nehemiah King of and from the attachment afd &c
be held at dividing Creek the third tuesday of June Anno Dom one thousand seven hundred and forty one to answer unto William Rowly of a plea of trespass upon the Case &.a and the same day is given to the afd William here &.a And hereupon the said William declared against the af.d Barnard in the plea af.d in form Following Somerset ss Bernard Ramsey late of Somerset County planter was attached to answer unto William Rowly of a plea of trespass upon the Case &.a And Whereupon the said William by George Douglas his attorny Complains that whereas the said Bernard on the fourth day day of August Anno Dom MDCCXXXiX at the County af.d did make his Certain note in writing Called a promissary note with the proper name and hand writing of the said Barnard signed and the said note to the said William then and there did deliver by which note the said Barnard did promise to pay to the said William the sum of three pounds fifteen Shillings to be paid in Indian Corn at twenty pence p Bushell at or before the first day of January then next ensueing the date of that note by means whereof and by force of the statute in |
