10 County Inholder and Susanna his wife were attached to Answer unto Francis Allen Jun.r of a plea of trespass upon the Case &.a And Whereupon the said Francis Allen Jun.r by Francis Allen Sen.r his attorney Complains that whereas he the said Francis Allen Jun.r is a good true faithfull and honest subject of our Lord the King now and as a good true faithfull and honest Subject of our ^said^ Lord the King and his Progenitors Late Kings of Great Brittain &.a from the time of his Nativity hitherto hath behaved held and Governed himself and of good name fame Creditt Condition Conversation of Life and Gesture by all the time af.d amongst all his neighbours and other faithfull Subjects of our Lord the King now was held and reputed and from all kind of theft felony fraud deceipt or any such wicked and base Crime or the procurement or suspition of the same in any sort through the whole Course of his Life untouched Clear Innocent free and altogether unsuspected hath Lived and Continued by reason whereof he the said Francis Allen Jun.r the favour esteem and good will of all his neighbours and other faithfull Subjects of our Lord the King now deserved had and obtained to his apparant and Manifest Advantage in all his affairs Nevertheless the said Susanna being not Ignorant of the premisses plotting and Malitiously Intending him the said Francis Allen Jun.r not Only of his good name fame Creditt estimation and repute af.d to deprive and him the said Francis Allen Jun.r into Ignoming and Opprobiousness to Induce and to Cause him Innocently to be brought in danger of being whipt and pilloryed and forfeiting four fold as the Law in such cases doth direct the twenty eighth day of August Anno Dom Seventeen hundred and thirty nine haveing speech with the said Francis Allen Jun.r in the presence and hearing of his neighbours and other faif faithfull Leige Subjects of our said Lord the King now openly and publickly those false feigned Scandelous and oprobious words following falsely and Malitiously to and of him the said Francis Allen Jun.r did assert publish pronounce and speak to witt vizt you speaking to and of him the said Francis Allen Jun.r) are a theif for you the said Francis Allen Jun.r meaning) stole wheat from your father and sold it to Peggy Peale by reason of the malitious speaking Publishing and declaring of which false Infamous Scandelous and opprobrious words the said Francis Allen Jun.r not only ^in^ his good name Fame Credit Estimate and repute af.d is very much hurt and damnified and also Sundry Sums of money & tobacco for the purgation & manifestation of his Innocency in that part is forced and Compelled to Expend & Layout to the damage of the said Francis Allen Junr of fifty pounds Curr.t money of Maryland and thereupon he brings Suit &c Pledg.s &c John Doe R Roe And the af.d Robert Geddes ^& Susannah his wife^ by their attorney af.d Cometh and defendeth the force and Injury when &c and pray to leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday |
