James Polk Daniel Jones & Ishmael Davis Came and were Sworn upon that Jury and because the test of the Jurors
of that same Jury did not appear therefore others of those standing by hereunto Elected by the Sheriffe of the County afd
and at the request of the aforesaid Francis Allen Jun and by the Command of the said Justices are newly put on whose
names to the pannell within written are afiled according to the form of the Statute in such Case made and provided which said
Jurors so newly putt on (to witt) Edmond Hough Thomas Mitchell Isaac Coston and Edward Rownd being Called Likewise
Came who to say the truth of the premisses together with the Other Jurors aforesaid first Impannelled and Sworn being Elected
tryed and sworn upon their Oath Say that the aforesaid Robert Geddes the day and Year abovesaid did not assert a firm
relate say and publish the aforesaid Words in the declaration aforesaid specified as the aforesaid Francis Allen Jun.r above
against him hath Complained

               Therefore it is Considered that the aforesaid Francis Allen Jun.r take nothing by his writt aforesaid but be
thereof in mercy for his false Clamour and that the aforesaid Robert Geddes goe thereof without day &.a also it is Considered
by the Court here that the aforesaid Robert Geddes Recover against the aforesaid Francis Allen Jun.r six hundred
and Ninety Eight pounds of tobacco for his Costs and Charges by him about his defence in this part Expended to the same
Robert by discretion of the Justices here adjudged according to the form of the Statute thereof made and provided &a

GD  Robert Geddes et uxor

     Command was given to the sheriffe of Somerset County that he should take Robert
Geddes Late of Somerset County Inholder and Susanna his wife if they should be found
                                           in his bailywick and them should safe keep so that he might have their bodys before the
Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of
November Anno Dom one thousand seven hundred and thirty nine to Answer unto Francis Allen
Jun.r of a plea of trespass upon the Case &.a  and the same day is given to the af.d Francis there &a

       Att which day here Came the af.d Francis Allen Jun.r by Francis Allen Sen.r his attorney
and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d Robert
Geddes and Susanna his wife whose bodys hereat this day he had ready to answer the af.d Francis
Allen Jun.r of the af.d plea as to him it was Commanded

    And hereupon the said Robert Geddes and Susanna his wife puts in this place George
Douglas Gent attorney at Law against the af.d Francis Allen Jun.r of the af.d plea

    Whereupon at the request of the parties af.d day is to them here given untill next Court
to be held at dividing Creek the third tuesday of March then next following in the same
state as at present saving to the parties af.d &a

    Att which day here Came againe the parties af.d by their attorneys af.d and hereupon the said
Francis Allen Jun.r Complained against the af.d Robert Geddes and Susanna his wife in the
plea af.d in form following                  Somerset County ss.t  Robert Geddes Late of Somerset
