10 tuesday of June then next following and they have it and the same day is given to the af.d Francis here also &a Att which day here Came again as well the af.d Francis Allen Jun.r as the af.d Robert Geddes and Susannah his wife by their Attorneys af.d and whereupon the said Robert and Susannah pray further leave thereof to Imparle here untill next Court to be held at dividing Creek in and for the County af.d the third tuesday of August then next following and they have it and the same day is given to the af.d Francis here also &.c Att which day here Came again as well the af.d Francis Allen Jun.r as the af.d Robert Geddes and Susannah his wife by their Attorneys af.d and whereupon the said Robert and Susannah as before defends the force and Injury when &c and say that she the said Susannah is not Guilty of the premisses by the said Francis above upon her Imposed in manner and form as the said Francis above against them hath Complained and of this they put themselves upon the Country And the plft in like manner Therefore it is Commanded the Sheriffe that Immediately he Cause to Come here before his Lordships Justices Twelve &.a by whom &.a and who neither &.a to recognize &.a because as well &a and whereupon the aforesaid Francis Allen Jun.r then and there his writt aforesaid against the aforesaid Robert Geddes and Susannah his wife did not present with Effect but voluntarily Suffered his Suit to be discontinued Therefore it is Considered that the aforesaid Francis Allen Jun.r and his pledges of Prosecuting to witt John Doe and Richard Roe are in mercy and that the aforesaid Robert Geddes and Susannah his wife goe thereof without day &a Also it is Considered that the aforesaid Robert Geddes and Susannah his wife Recover against the aforesaid Francis Allen Jun.r three hundred and Sixty One pounds of tobacco for their Costs and Charges by them about their defence in that part sustained to the same Robert and Susannah by their Court here of their assent adjudged according to the form of the Statute thereof Lately made and provided and that the aforesaid Robert and Susannah have thereof Execution &a
and thirty nine to Answer unto Alex.a Buncle of a plea that he render unto him twelve pounds nine shillings and ten pence half penny Curr.t money of Maryland which to him he owes and unjustly detains &.c And the same day is given to the aforesaid Alexander here &c Att which day here Came the af.d Alex.a Buncle by George Douglas his Attorney and the sheriffe to witt John Henry Gent now here returned that he had taken the af.d Hugh Henrey whose body here at this day he had ready to Answer the af.d Alexander Buncle of the af.d plea as to him it was Commanded &.a Whereupon Came herinto Court a Certain John Schoffield of Somerset County planter in his proper person and undertook for the said Hugh Henry [Likewise the said Hugh Henry present here in Court in his proper person Assumed upon himself that if it should happen that Judgment in the plea af.d should ^be^ rendered for the same Alexander against him the said Hugh or that he the said Hugh should be therein Convict that then he the said Hugh should pay and Satisfie unto the said Alexd the |
