98 Six before Robert King Gentleman and Others his associates Justices of his the said Lord Proprietary the peace in the County afd to Conserve and also divers felony's trespasses and other Malefesances in ye same County Committed to hear and determine assigned by the Oath of Alexander Lackie and twelve others being presented that Mary Crowley late of Somerset parish in the County afd Spinster the first day of march ann.o Dom Seventeen hundred and thirty Six at the parish aforesaid in the County afd within the Jurisdiction of this Court did commit fornication with a Certain person to the Jurors aforesaid unknown and did permitt the Same unknown person then and there to have Carnal Knowledge of her body and to beget then and there a bastard Child on the body of her the same Mary to the high displeasure of Almighty God to the Evill Example of all others in such Case Offending contrary to the peace of the said Lord proprietary that now is his good rule & Government and against the form of the act of assembly in Such Case Lately made and provided &c Thereupon Command was Given to the Sheriffe of Somerset County that he Should take the said Mary Crowley if She should be found in his Bailywick and her should safe keep so that he might have here body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of June ann Dom One thousand Seven hundred and thirty Seven to answer unto his said Lordship of the Fornication afd whereof she was Indicted &.c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek afd Came the Sheriffe of the County afd and returned that the afd Mary Crowley was not found in his bailywick Therefore Command was againe given to the Sheriffe of the County afd that he Should take the aforesaid Mary Crowley if &.c and her safe &.c so that he might have her body before the Justices of his Lordship County Court of Somerset to be held at Dividing Creek the third Tuesday of August Ann Dom One thousand Seven hundred and thirty Seven to answer his Said Lordship of the fornication afd whereof she was Indicted &c Att which day here Came the said Mary Crowley in her proper person and had a hearing of the Indictment afd and saith that She Cannot deny but that She is Guilty of the premisses afd in the Indictment afd Specified in Manner & form as by the Indictment afd above and the premisses afd Expressly Acknowledgeth but refuseth to declare the father of her bastard Child she stands Indicted for whereupon all & Singular the premisses by the Court here being seen and fully understood It is Considered that the afd Mary Crowley be whipt with ^twenty^ five Stripes on the bare back well Laid on untill the blood appear at the publick whiping post at dividing Creek and that the said Mary Crowley be taken &.c And thereupon as to the Corporall punishment afd Command is Given to the Sheriff of the County afd that he do thereof Immediate Execution by whiping of the afd Mary Crowley at |
