98 Given to the afd Jacob here also &c Att which day here Came againe as well the aforesaid Jacob Waggaman as the afd James Carey by their attorneys afd and whereupon the same James Carey prays further Leave thereof to Imparle hereuntill the third Tuesday of August then next following and he hath it and the same day is Given to the afd Jacob here also &c Att which day here Came againe as well the afd Jacob Waggaman as the afd James Carey by their attorneys aforesaid and whereupon the same James Carey as before defends the force and Injury when &c and saith that he is not Guilty of the premisses above upon him Imposed as the afd Jacob above against him hath Complained and of this he puts himselfe upon the Country and ye said Jacob in Likeman Thereupon it is Commanded the Sheriffe of the County afd that Immediately he Should Cause to Come here third Tuesday of August twelve &c by whom &c and who neither &c to recognize &c because as well &c & the same day is given to the afd parties here &c and the Jurors of that Same Jury by John Henry Gent sheriffe of the same County afd to this Impannelled being Called Came to witt Edmond Hough Joshua Caldwell John Pope Alexander Lackie Samuel Long Robert Collier Nehemiah Holland John Goslen William Turpin John Covington Benjamin Holland and robert Mitchel when he say the truth of the premises afd being duely Elected tryed and Sworn upon their Oath do say that ^the afd^ James Carey is Guilty of the premisses afd in manner and form as the afd Jacob Waggaman above against him hath Complained and assessed the damages of the same Jacob by occasion of the premisses afd beyond his Costs and Charges ^by him about his suit^ in that part apposed to six pounds Eleven Shillings and eight pence Curr.t money of Maryland and for those Costs and Charges to one pound of tobo Therefore it is Considered that the afd Jacob Waggaman Recover against the afd James Carey his damages aforesaid by the Jurors afd in form afd assesed as also Twelve hundred & fifty seven pounds of tobacco for his Costs and Charges afd to the same Jacob by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount to six pounds of tobacco Eleven shillings and Eight pence Curr.t money of Maryland and Twelve hundred and fifty Eight pounds of tobacco & ye afd James in Mercy &c
