87 as af.d Recovered against him with the additionall Cost thereon on the tenth day of february next taken this 11.th day of may 1737 John Handy R Dashiell
to any person your petitioner therefore prays your worshipfull would be pleased to discharge your petitioner from the said Patrick Dailey and your petitioner as is duely bound shall ever pray Richard Jones Thereupon Command is given to the Sheriffe of Somerset County that he Should Somons the same Patrick Daley if &.c so that he be June to answer the petition afd &.c And afterwards to witt this third Tuesday of June one thousand seven hundred & thirty seven Came here the Sheriff of the County afd to witt Joseph McClester Gent and At the same day returned that he had Sumoned the afd Patrick Daley to answer &.c as afd he was Commanded Upon which day Came here into Court as well the afd Richard Jones as the afd Patrick Daley in their proper persons and the petition aforesaid being read and the severall allegations on both parties and what the wittnesses delivered upon Oath all which being heard and Mature deliberation thereupon had as well on the part of the petitioner as on the part of the said Patrick Daley and Likewise the Indenture by which the said Patrick Daley held the said Richard Jones as a Servant being by the Court here seen and fully understood It is Considered that the said Richard Jones from the service of the said Patrick Daley be discharged and go thereof without day for that the afd Indenture by which the same Patrick held the same Richard as a Servant is adjudged not good and further it is Considered that the afd Richard Jones recover against the afd Patrick Daley 237 pounds of tobacco for his Costs and Charges by him in this part Expended by the Court here adjudged &c |
