75 and last will of Thomas Tate Late of Somerset County Schoolmaster was attached to answer unto Benjamin Hayman of a plea of trespass upon the Case &c And Whereupon the said Benj.a by Rob.t Jenckins Henry his attorney Complains that whereas the af.d Thomas in his life time (to witt) the tenth day of January in the year of our Lord one thousand seven hundred thirty and five at Somerset County af.d within the Jurisdiction of this Court was Indebted to the Benj.a in the sum of four pounds fourteen shillings and six pence Curr.t money of Maryland for sundry Articles properly chargeable in an account (as by an Account thereof hereinto Court brought may appear) and so thereof being Indebted the same Thomas in his life time (to witt) the day and year af.d at the place af.d in Consideration thereof upon himself did assume and to the said Benj.a then and there did faithfully promise that he the said Thomas the af.d four pounds fourteen shillings and six pence unto the said Benj.a when he should afterwards thereunto requested he would well and faithfully pay and Content and altho the said Thomas in his lifetime one pound six shillings and seven pence part of the af.d four pounds fourteen shillings and six pence to the said Benj.a he since paid and satisfied Nevertheless as to three pounds seven shillings and eleven pence thereof residue the said Thomas in his life time and the af.d mary since the decease of the af.d Thomas the promise and assumptions of the said Thomas in his lifetime so as af.d made nothing regarding but plotting and fraudulently intending the said Benj.a in that part Craftily and subtilly subtilly to deceive and defraud the said three pounds seven shillings and eleven pence Curr.t money af.d to the said Benj.a hath not paid nor either of them hath paid or Contented altho' the same Thos in his lifetime (to witt) on the eleventh day of february Anno Dom seventeen hundred thirty and five and often afterwards and the said mary since the decease of the said Thomas (to witt) on the twelfth day of July in the year of our Lord seventeen hundred thirty and six and often since that time at Somerset County af.d was thereunto requested by him the said Benj.a but the same to the said ^Benj.a^ to pay the said Thomas in his lifetime did refuse and the same to the said Benj.a to pay the said Mary doth still refuse and deny therefore the said Benj.a that he is the worse and hath damage to the value of seven pounds Curr.t money of the province af.d and thereupon he brings suit &c Pledges &c Jno Doe R Roe
