Curr.t Money of Maryland  And for those Costs and Charges to One pound of tobacco

       thereupon the said Samuel Hopkins prays that upon giveing Security according to act of
assembly the afd Sum of twelve pounds Curr.t money may be Condemned Goe the hands of the
afd William Whittington  Whereupon Edward Rownd of Somerset County Gent present herein
Court in his proper person undertook for the Said Samuel Hopkins that in Case the Said John
Donelson do at any time within a year & a day appear and make all or any part of the Said
Samuel Hopkins Claim against him appear to be Satisfied or otherwise to be undue before the
Lying of the attachment afd that then the said Samuel Hopkins shall make restitution unto him
the Said John Donelson of all or Such part thereof as shall be made appear to be undue &c or that
he the said Edward Rownd will do the Same for him &c

          Therefore it is Considered that the afd Twelve pounds Curr.t money of Maryland by the
Jurors afd in form afd found be Condemned in the hands of the said William Whittington
as of the rights and Creditts of the afd John Donelson towards satisfying unto the afd Samuel
Hopkins his damages and Costs and that he have thereof Execution according to act of assembly and also
it is Considered that the afd Samuel Hopkins recover against the Same William Whittington
612   Six hundred and fifty Eight             pounds of tobacco by the Court here for his Costs
and Charges of his assent adjudged and the afd W.m in Mercy &c

     Command was given to the Sheriffe of Somerset County that he should
take May Tate Executrix of the testament and Last Will of Tho
Tate Late of Somerset County Schoolmaster if she should be found in his
bailywick and her safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held at Dividing Creek in the Same County the third Tuesday of August
Anno Dom One thousand seven hundred and thirty Six to answer unto Benjamin Hayman of
a plea of trespass upon the Case &c and that thereof he Should not fail &c

    Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came
the said Benjamin Hayman by Robert Jenckins Henry his attorney and the Sheriffe of the Same County
to witt Joseph MccClester Gent at the same day here Returned that he had taken the afd Mary Tate whose
body here at this day he had ready to answer the afd Benjamin of the afd plea as to him it was Commanded
                    And hereupon the same Benjamin Hayman declared against the afd Mary Tate
in the plea aforesaid in form following viz.t  Somerset County ss  Mary Tate Executrix of the testament
