74 by their attorneys af.d and whereupon the same W.m Whittington prays further Leave thereof to Imparle ^here^ untill ^next Court to be held at dividing Creek^ the third tuesday of March then next following and he hath it and the same same day is given the af.d Samuel here also &c Att which day here Came againe as well the af.d Samuel Hopkins as the af.d W.m Whittington by their attorneys af.d and whereupon the same W.m Whittington prays further Leave thereof to Imparle hereuntill ^next Court to be held at dividing Creek^ the third tuesday of June then next following and he hath it and the same day is given to the af.d Samuel here also &c Att which day here Came againe as well the afd Samuel Hopkins as the afd William Whittington by by their attorneys afd and whereupon the same William Whittington as before defends the force & Injury when &c and saith that the said Samuel Condemnation and Execution of the premisses so as af.d attached in his hands to have ought not because he saith that the af.d W.m hath not nor at the day of Laying the said Attachment in his hands had any Goods Chattells Rights or Creditts of the said John Donnelson and this he is ready to verify wherefore he prays Judgment if the af.d Samuel Condemnation and Execution of the premisses as af.d in his hands attached to have ought &c And the af.d Samuel says that he by any thing by the said William in his plea af.d prealledged from having condemnation of the premises in the hands of the said William ought not to be precluded because he says that the af.d William on the day of Issueing the originall writt by the said Samuel in this case impetrated and at the day of The laying the attachment af.d in his hands to witt on the fourteenth day of June Anno Dom seventeen hundred thirty and six at Somerset County the af.d W.m ^had^ in his hands Goods and chattels of the said John of value sufficent to satisfy the said Samuel the af.d sum of fifteen pounds Curr.t money in the hands of the said W.m in the Return of the the said writ of attachment mentioned to be attached and this he prays may be enquired by the Country and the said W.m in like manner Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he Should Cause to Come ^here^ before the afd Justices twelve &c by whom &c and who neither &c to recognize &c because as well &c and Immediately Came thereof the Jury &c and the Jurors of that Same Jury by Joseph McClester Gent Sheriffe of the County afd to this Impannelled being Called Came to witt Thomas Dixon James Nearn Thomas Williams Jun.r Robert Mitchell Solomon Long John Webb Francis Crowder William Jones Joseph Gillis Wm Gray Thomas Perkins and William McClemmey who to say the truth of the premisses afd being duly Elected tryed & Sworn upon their Oath Say that the afd William Whittington Garnishee as afd had in his hands at the day of the Laying of the attachm.t afd Goods and Chattells Rights or Creditts of the said John Donnelson to the Value of Twelve pounds Curr.t |
