74 Boston money and five hundred pounds of tobacco and when you have the same attached or any parte thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of June Next then and there to be Condemned according to Act of assembly to and for the use of a Certain Samuel Hopkins unless the said John Donnelson by himself or his attorney shall appear and answer unto the said Samuel Hopkins in a plea of trespass upon the Case &c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and ^a^ppear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly (in such case made and provided) if to him her or them it shall seem meet and how you shall execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this writt wittness John Smith Gen.t one of our Justices of our said Court the twentyeth day of march Anno Dom one thousand seven hundred and thirty five Att which day here Came the afd Samuel Hopkins by George Douglas his attorney and the Sheriffe of Somerset County to witt Joseph McClester Gent at the same day returned the writt afd in form following viz.t By vertue of the within Writt to me directed to the Justices within mentioned I Certifie that I have on the fourteenth day of June attached in the hands of William Whittington of the goods and Chattells right and Credits of Capt John Donelson for the Use of Cap.t Samuel Hopkins to the value of fifteen pounds Curr.t Money and I further Certifie that by John Doe and Richard Roe good and Lawfull men of my Bailywick that they ^he^ be and appear at the time and place within Contained to shew &c And the said William Whittington Garnishee as afd by Francis Allen his attorney Comes and defends the force and Injury when &.c and prayeth Leave thereof to Imparle here untill ^next Court to be held at dividing Creek^ the third Tuesday of August then next following and he hath it & the same day is given to the afd Samuel here also &.c Att which day here Came againe as well the afd Samuel Hopkins as the afd William Whittington by their attorneys afd and whereupon the Same William Whittington prays further Leave thereof to Imparle hereuntill ^next Court to be held at dividing Creek^ the third Tuesday of November then next following and he hath it and the same day is given to the afd Samuel here also &c Att which day here Came againe as well the af.d Samuel Hopkins as the af.d W.m Whittington by |
