73 thirty six before his Lordships Justices here Came as well the afd Samuel Beekley as the afd Abraham Ingram by their attorneys afd and the Same Abraham defends the force and Injury &.c and prayeth Leave thereof to Imparle here untill the third tuesday of March then next following and he hath it & the same day is given to the afd Samuel here also &c Att which day here Came againe as well the af.d Samuel Beekley as the af.d Abraham Ingram by their attorneys af.d and whereupon the same Abraham prayeth further LEave thereof to Imparle here untill the third tuesday of June then next following and he hath it and the same day is given to the af.d Samuel here also Att which day here Came againe as well the af.d Samuel Beekley as the af.d Abraham Ingram by their attorneys af.d and whereupon the same Abraham as before defends the force and Injury when &c and saith that he did not assume upon himself in manner and form as the said Samuel above against him hath complained and of this he puts himself upon the Country &c And the af.d Abraham prays that the af.d Samuel may Reply to the plea of the same Abraham and afterwards the same Samuel altho' Solemnly Called cometh not nor to the plea of the same Abra^ham^ replyeth nor is his writt af.d against the said Abra^ham^ further prosecuted Therefore it is Considered that the af.d Samuel Beekley take nothing by his writt af.d but that he and his pledges of prosecuting to wit John Doe and Richard Roe be in mercy and that the af.d Abraham goe thereof without day &c and further it is Considered that the af.d Abra Ingram recover against the af.d Samuel Beekly: Two hundred & Sixteen 216 : pounds of tobacco for his Costs and Charges by him about his defence af.d in that part sustained to the same Abraham Ingram by the Court here according the form of the Statute in such case lately made and provided adjudged and that the same Abraham have thereof Execution &c
if they shall be found in your bailywick to the value of seventeen pounds nine shillings and three pence Curr.t money of Maryland and twenty one pounds one shilling and four pence half penny Boston |
