72 Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the af.d Samuel Beekley by Geo Douglas his attorney and the sheriff of the same County to witt Joseph M.ccClester Gen.t at the same day here returned that he had taken the af.d Abraham Ingram whose body at this day he had Ready to answer the af.d Samuel Beekley of the af.d plea as to him it was Commanded And Whereupon the af.d Abraham Ingram by Francis Allen his attorney Came here before the af.d Justices and prayes that the af.d Samuel Beekley may give Security for Costs according to Act of assembly in such case made provided in Case he be nonsuited in the plea af.d which by the Court granted thereupon Geo: Douglas of Somerset County Gen.t present herein Court in his proper person undertakes for the said Samuel Beekley that if in Case he be nonsuited in the plea af.d ^or^ otherwise Legally Cast that then he the said Samuel Beekley shall pay the Judgment of the Court and all Costs arriving thereon to the said Abraham Ingram or that he the said George Douglas will do the same for him Whereupon at the Request of the parties day is given to the parties af.d here before his Lordships Justices untill the third tuesday of Aug.t then next following in the state wherein they now are saving to the parties af.d &c Att which day before his Lordships Justices here Came as well the af.d Samuel as the af.d Abraham by their attorneys afd and at the request of the parties afd further day is given to the parties afd in the plea afd here untill the third Tuesday of November then next following in the Same State wherein they now are saving to the parties afd &c And hereupon the said Samuel Beekley declared against the said Abra: Ingram in form following Somerset ss.t Abraham Ingram late of Somerset County planter was attached to answer unto Samuel Beekley of a plea of trespass upon the Case &c And whereupon the said Samuel by Geo: Douglas his attorney complains that whereas the said Abraham on the twenty third day of October Anno Dom seventeen hundred and thirty three at the County of Somerset af.d within the Jurisdiction of this Court was indebted to the said Samuel in the sum of twenty pounds five shillings and four pence half penny Curr.t money of Maryland for sundry goods wares and merchandise by the said Samuel to the said Abraham at the especiall Instance and request of the said Abraham before that time sold and delivered and so being thereof Indebted on Consideration thereof afterwards to witt the day and year af.d at the County af.d upon |
