72 And the afd William Phillips by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill the third Tuesday of November then next following and he hath it & the same day is Given to the afd Samuel here also &c Att which day here Came againe as well the afd Samuel Beekley as the afd William Philips by their attorneys afd and whereupon the same William prayeth further Leave thereof to Imparle here untill the third Tuesday of March then next following and he hath it and the same day is Given to the afd Samuel here also &c Att which day here Came againe as well the af.d Samuel Beekley as the af.d William Philips by their attorneys af.d and whereupon the same William prayeth further Leave thereof to Imparle here untill the third tuesday of June then next following and he hath it and the same day is given to the af.d Samuel here also &c Att which day here Came againe as well the af.d Samuel Beekley as the af.d W.m Philips by their attorneys af.d And whereupon the same W.m as before defends the force and Injury when &c and saith that that he did not assume upon himself in manner and form as the said Samuel above against him Hath Complained and of this he puts himself upon the Country &c and the aforesaid William prays that the afd Samuel may reply to the plea of the same William and afterwards the same Samuel altho' Solemnly Called Cometh not nor to the plea of the Same William replyeth nor is his writt afd against the Same W.m further prosecuted Therefore it is Considered that the afd Samuel Beekley take nothing by his writt afd but that he and his pledges of prosecuting to witt John Doe and richard Roe be in mercy and that the afd William Phillips goe thereof without day &c and further it is Considered that the afd W.m Phillips recover against the afd Samuel Beekley Two hundred and Sixteen 296 pounds of tobacco for his Costs and Charges by him about his defence afd in that part Sustained to the Same William Phillips by the Court here according to the form of the Statute in such Case ^lately^ made and provided adjudged and that the same William have thereof Execution &c
to be held in the Court house at dividing Creek in the same County the third tuesday of June Anno Dom one thousand seven hundred and thirty six to answer unto Samuel Beekley of a plea of trespass upon the Case &c and that thereof he should not fail &c Att |
