71 Court house ^at Dividing Creek^ in the Same County the third Tuesday of June Anno Dom One thousand Seven hundred and thirty Six to answer unto Samuel Beekley of a plea of trespass upon the Case &.c and that thereof he Should not fail &c Att which day here before the Justices before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd Samuel Beekley by George Douglas his attorney and the Sheriffe of the Same County to witt Joseph McClester Gent at the same day ^here^ returned that the had taken the afd William Phillips whose body here at this day he had ready to answer the afd Samuel Beekley of the afd Plea as to him it was Commanded And whereupon the aforesaid William Phillips by Francis Allen his attorney Came here before the afd Justices and prays that the afd Samuel Beekley may give Security for Costs according to act of assembly in Such Case provided in Case he be non suited in the plea afd which is by the Court here granted thereupon George Douglas of Somerset County Gent present herein Court in his proper person undertakes for the said Samuel Beekley that if in Case he be nonsuited in the plea afd or Otherwise Legally Cast that then he the said Samuel Beekley shall pay the Judgm.t of the Court and all Costs accrewing thereon to the said William Phillips or that he the said George Douglas will do the Same for him Whereupon at the request of the parties day is given to the partyes afd here before his Lordships Justices untill the third Tuesday of August then next following in the State wherein they now are saving to the parties afd &c Att which day before his Lordships Justices here Came as well the afd Samuel as the afd William by their attorneys afd and Whereupon at the request of the parties afd further day is given to the parties afd in the plea afd here untill the third Tuesday in Novemr then next following in the state wherein they now are saving to the parties afd &c And hereupon the said Samuel Beekley declared against the same William Phillips in the in the plea afd in form following viz.t Somerset ss William Phillips late of Somerset County planter was attached to answer unto Samuel Beekley of a plea of trespass upon the Case &c And whereupon the said Samuel by Geo: Douglas his attrny complains that whereas the said William on the twenty eighth day of october Anno Dom MDCCXXXiv at Somerset County af.d within the Jurisdiction of this Court was indebted to the said Samuel in the sum of twenty two pounds six Shillings and nine pence half penny Curr.t money of Maryland for sundry sums of money to sundry persons by the said Samuel for the said William Philips and at the especiall request and Instance of the said W.m before that time paid and for goods wares and merchandise by the said Samuel to the said William and at the like Instance of the said W.m before that time sold and delivered and for sundry other matters and things properly lying in account as by account |
