and thirty Seven before Robert King Gent and others his associates Justices of his the said Lord Proprietarys peace in the Same County to Conserve and also divers felonys trespasses and other Malefeasances in the Same County Committed to hear and determine assigned by the Oath of William Holland and twelve others presented that Eleanor Mahony late of Stepney parish in Somerset County Spinster the tenth day of November Anno Dom seventeen hundred thirty and six at the parish af.d in the County af.d within the Jurisdiction of this Court did commit fornication with a Certain person to the Jurors af.d unknown and did permit the same unknown person then and there to have carnal knowledge of her body and to beget then and there a bastard Child on the body of her the same Eleanor to the high displeasure of almighty God to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary that now is his good Rule and Goverment and against the form of the Act of assembly in such case offending lately made and provided &c Thereupon Command was Given to the Sheriffe of Somerset County that he Should take the Said Eleanor Mahony if &c to answer &c and afterwards to witt the Same third Tuesday of June being the twenty first day of the Same Month ann Dom One thousand Seven hundred and thirty Seven that Same term before his Lordships the right honrble the Lord proprietary his Justices at dividing Creek in the County afd Came the Said Eleanor Mahony in her proper person afd and had a hearing of the Indictment afd and Saith that She Cannot Gainsay but that she is Guilty of the premisses afd in the Indictment Specified in manner & form as by the Indictment aforesaid above against her Supposed and the premisses in the Indictment afd Expressly acknowledgeth and makes Oath that a Certain Timothy Meddin is the begetter of the Child She stands Indicted for but hath not wherewith to pay her fine for the fact afd but puts herselfe on the favour of the Court Whereupon all and Singular the premisses by the Court here Seen and fully understood It is Considered that the af.d Eleanor Mahony be whipt at the publick whiping post at dividing Creek in the County af.d with fifteen Strips on the bare back well Laid on untill the blood appear and that the said Eleanor Mahony be taken &c And thereupon as to the Corporall punis^h^ment af.d Commanded is given to the sheriff of Somerset County that he do thereof Imediate Execution by whiping of the said Eleanor Mahony at the publick whiping post with fifteen stripes on the bare back well Laid on untill the blood appear it being adjudged satisfaction for the offence af.d &c and afterwards in the same Court for the |
