55 the Lord Proprietarys Justices at dividing Creek in the County afd Came the aforesaid Balmforth Salt according according to a Certain Recognizance by him and his Security in that part first made in his proper person and had a hearing of the Indictment aforesaid and saith that he Cannot Gainsay but that he is Guilty of the premisses afd in ye Indictment Specified in manner and form as by the Indictm.t af.d above against him supposed and the premisses af.d Expressly acknowledgeth and puts himself thereof in mercy of his Lordship Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered that the af.d Balamforth salt pay unto his Lordship the right Honourable the Lord proprietary for his fine by the Court hereupon him ^im^posed for and by occasion of the premisses af.d whereof in form af.d he is Convicted thirty shillings curr.t money of Maryland (to the use of the County af.d) and that he said Balamforth Salt be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said Balam forth Salt is Ordered to give Security to Save and keep Indempnified the Justices of Somerset County and their Successors from all Costs Charges and Burthens that Might accrew by means of the birth of the Child &.c Thereupon the said Balmforth Salt with George Smith his Security of Somerset County planter both present herein Court in their proper persons acknowledged themselves Indebted unto his Lordship the Right Honourable the Lord proprietary of the provinces of Maryland in the full and just sum of thirty pounds sterling good and lawfull money of England of their bodys goods or Chattells Lands or tenements Joyntly and severally to be made and Levied to the use of the Justices of the County af.d and their Success^ors^ If it happen that the said Balm + forth salt his heirs Executors or administrators or any of them do and shall not from time to time and at all times hereafter acquitt discharge and save harmless as well the Justices of Somerset County af.d and their Successors for the time being as also the Inhabitants of the said County of and from all Costs Charges troubles and Incumbrances whatsoever for or by Reason of the birth maintainance nourishing and bringing up of the said Child and of and from all others suits Charges troubles and demands whatsoever touching or Concerning of the same &c Likewise the said Balmforth Salt is ordered to give Security for the payment of the Severall Officers their Fee or Fees due by means of the ^premisses afd in the^ Indictment afd &.c Thereupon the same Balmforth Salt with John Persons of Somerset County planter his Security both present herein Court acknowledged themselves Indebted unto his Lordship the Lord proprietary in the Sum of Eight hundred pounds of tob.a to be Levied on their bodys Goods or Chattells Lands or tenements for the Use of the Severall Officers that hath a right to any fee or Fee on the Indictment afd &c If it happen that the Same Balmforth do not pay and Satisfie unto the Severall Officers the Just Fee or Fees ^due^ on the Indictment afd &c |
