53 sterling good and Lawfuill money of England of their bodys goods and Chattells Lands and tennements to the Use of the Justices of the County af.d and their Successors to be made and Levied If it happen that the said Eliz.a Ellingsworth her heirs Executors or administrators or any of them doe and shall not from time to time and at all times hereafter acquitt discharge and save harmless as well the Justices of Somerset County af.d and their Successors for the time being as also the Inhabitants of the said County of and from all Costs Charges troubles & and Incumbrances what soever for or by reason of the birth maintainance nourishing and bringing up of the said Child and of and from all other suites Charges troubles and demands whatsoever touching or Concerning of the Same &.a
Seven hundred and thirty Six before John Smith Gent and others his associates Justices of his the said Lord Proprietary the peace in the County afd to Conserve and also divers Felonies trespasses and other Malefeasances in the Same County Committed to hear and determine assigned by the oath of Alexander Lackie and twelve others being presented that John Whitehead late of all hollows parish in the County af.d planter the tenth day of november Anno Dom seventeen hundred thirty and six at the parish af.d in the County af.d within the Jurisdiction of this Court did commit fornication with a Certain Mary Walker and of her body then and there had carnal knowledge and a Basterd Child on the body of her the same Mary then and there did beget to the high displeasure of allmighty God to the Evil example of all others in such Case offending contrary to the peace of the said Lord proprietary that now is his good Rule and Goverment and against the form of the act of assembly in such case lately made and provided &c By which it was Commanded the sheriff of Somerset County that he should take the said John Whitehead Late of all hallows parish in Somerset County planter if he should be found in his bailywick and he should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek the third tuesday of June Anno Dom one thousand seven hundred and thirty seven to answer unto his said Lordship &c And afterwards to witt the said third tuesday of June Anno Dom one thousand seven hundred and thirty seven that same term before his Lordships Justices at dividing ^Creek^ af.d Came the said John Whiteh^e^ad in his proper person and had a hearing of the Indictm.t af.d and saith that |
