52 his said Lordship the peace in the County af.d to confer and also divers Felonies trespasses and other Malefeasances in the same County Committed to hear and determine assigned by the oath of Alex.d Lackey and twelve others being presented that Eliz.a Ellingsworth ^Jun.r^ late of Stepney parish in the County af.d Spinster the second day of march Anno Dom seventeen hundred thirty and six at the parish af.d in the County af.d within the Jurisdiction of this Court did comit fornication with a Certain person to the Jurors af.d unknown and did permit the same unknown person then and there to have carnal knowledge of her body and to beget then and there a basterd child on the body of her the same Eliz.a to the high displeasure of almighty God to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary that now is his good Rule and Goverment and against the form of the Act of assembly in such case lately made and provided &c By which it was Commanded the sheriff of Somerset ^County^ that he should take the said Eliz.a Ellingsworth late of Stepny parish in Somerset County Spinster if she should be found in his balywick and her should safe keep so that he might have her body before the Justices of his Lordship County Court of Somerset to be held in the Court house at dividing Creek the third tuesday of June Anno Dom one thousand seven hundred and thirty seven to answer unto his said Lordship &c And afterwards to witt the said third tuesday of June Anno Dom one thousand seven hundred and thirty seven that same term before his Lordships Justices at dividing Creek af.d Came the said Eliz.a Ellingsworth in her proper person and had a hearing of the Indictm.t af.d ^and saith that she Cannot deny but that she is Guilty of the premises afd in the Indictment afd^ Specified in manner and from as by the Indictm.t af.d above against her Supposed and the premisses af.d expressly acknowledgeth and makes oath that a Certain Richard Nichols is the begetter of the Child she stands Indicted for and puts herself in mercy of his Lordship &c Whereupon all and Singular the premises being seen and by the Court fully understood It is Considered that the af.d Eliz.a Ellingsworth pay unto his Lordship the Right honourable the Lord proprietary for her fine by the Court hereupon her Imposed for and by Occasion of the premisses af.d whereof in form af.d she is Convicted thirty shillings Curr.t money of Maryland (to the use of the County af.d) and that the said Eliz.a Ellingsworth be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said Elizabeth Ellingsworth is ordered to give Security to Save and Keep Endempnified the Justices of Somerset and their Successors from all Costs Charges and Burthens that might accrew by means of the birth of the Child afd &.a Whereupon the said Eliz.a Ellingsworth with Walter Darby of Somerset County planter her Security both present herein Court in their proper persons Acknowledged themselves Indebted unto his Lordship the Lord proprietary in thirty pounds sterling |
