39 Now here at this day to witt the fifteenth day of March ann Dom one thousand seven hundred and thirty Six Came here into Court David Wilson Robert Jenckins Henry and John Henry Gent three of the Commissioners nominated in the foregoing Commission and made return thereof Endorsed with the severall depositions thereunto annexed as followeth Somerset ss.t Wee the subscriber Commissioners appointed by Somerset County Court to Examine evidences in relation to the bounds of the tract of Land within mentioned called Ledburn do hereby Certifie that by Virtue of the within Commission to us directed wee have taken the depositions hereto annexed at a meeting by us had upon the said Land in presence of all the partys concerned having first given notice of our said meeting according to the directions of the Act of assembly in such case lately made and provided Robert Jenckins Henry John Henry and David Wilson Somerset County ss.t Depositions of Wittnesses taken before us David Wilson Robert Jenckins Henry and John Henry in Relation to the bounds of a parcell of Land Called Ledburn on behalf of a Certain Sarah Hull and Beachamp Davis by Vertue of a Commission Issueing out of the County Court of Somerset to us directed for the Examination of evidences concerning the bounds of the said Land at our meeting upon the said Land the seventeenth day of December in the year of our Lord one thousand seven hundred thirty and six Philip Adams of Somerset County in the province of Maryland planter aged fifty eight years being sworn upon the holy evangelist of almighty God deposeth as followeth that about four years agoe he this deponant was desired by Edward Beachamp and Edward Hull now dec.d to be an evidence to a division then made between them of part of a tract of Land Called Ledburn which division as this deponent well Remembers did begin at an old maple tree marked by Beachamp Davis at the Request and by Content of both partys standing at the mouth of a small Branch near the now dwelling house of the said Edward Beachamp and to the westward thereof and thence divided by a ditch tending to the eastward of south thro the cleared ground and a considerable distance in to the woods to a turn of the said ditch near where a small Red oak is now marked with two Notches upon each side of the said tree and from thence with a straight line to a Sliped Red Oak standing upon a Ridge near the extent of the said Land near a small path that leads from the County Road to the said Edward Beachamps plantation and this deponent further saith that at the time of the said Division there was some conversation between the said Edw.d Beachamp and the said Edward Hull in Relation to a former agreement but they differed upon the terms of the said former agreement and further this deponent saith not his Philip D Adams mark William Adams of Somerset County in the province of Maryland planter aged fifty six years or thereabouts being sworn upon the holy evangelist of almighty God deposeth as followeth that about four years agoe he this deponent with his brother Philip Adams was desired by Edward Beachamp and Edward Hull now dec.d to be an evidence to a division then made between them of part of a tract of Land called Ledburn which division as this deponent well Remembers did begin at an old maple tree marked by Beachamp Davis at the request and Consent of both partys |
