39 partys standing at the mouth of a small Branch near the now dwelling house of the said Edward Beachamp ^and^ to the westward thereof and thence divided by a ditch tending to the eastward of south thro the cleared ground and a considerable distance into the woods to a turn of the said ditch near where a small Red Oak is now marked with two notches upon each side of the said tree and from thence with a Straight line to a Sliped red oak standing upon a Ridge at the extent of the said Land near a small path that leads from the County Road to the said Edw.d Beachamps plantation and this deponant further saith that at the time of the said division there was some conversation between the said Edw.d Beachamp and Edw.d Hull in relation to a former agreement but they differed upon the term of the said former agreement and further this deponent saith not his William W Adams mark
Lordship his heirs and Successors The Condition of the above Recognizance is such that if the above bound Francis Tate shall take his prsonall appearance at march Court next and not depart the same Court without LEave thereof and in the mean time to be of Good behaviour to all his Lordships good people but more especially to Tarrence Gallaspie then this Recognizance to be void and of none effect or else to be and Remain in full force power and Vertue taken before Henry Ballard Now hereat this day to witt the fifteenth day of March Ann Dom One thousand Seven hundred and thirty Six Came here into Court the afd Francis Tate in his proper person according to the recognizance afd and pray that his appearance ^may be recorded^ & he and his Security discharged &.c thereupon the said Frances Tates appearance is recorded and he and his security accordingly discharged &c Whereupon the said Francis Tate is ordered by the Court here to give Security for the payment of the Severall Officers their Fees due upon the recognizance afd thereupon a Certain Heber Whittingham of Somerset County Gent present herein Court undertook for the said Francis Tate to pay the Severall Officers their Fee or Fees due by means of the recognizance aforesaid In Case the said Francis Tate doth not pay the same &c These are to Certifie whom it may Concern that we the subscribers pursuant to an order of Somerset County Court dated the 18.th day November 1735 have Laid out a bridle path for Robert Harris from his dwelling plantation in parrahawkin neck to his upper plantation at the head of parrahawkin neck by the side of a great swamp leaving the high ground opposite to the plantation of John Denstons and John Phillips given under our hands the day of Anno Dom 1735 Jas Ward Randal Smullen |
