38 one shilling and fou^r^ pence to be paid unto the said William Wheatly Sarah Wheatly Michael Roach and Stephen Roach their heirs Ex.rs administrators or assignes or assignes to the which payment well and truly to be made and done we bind ourselves our and either of our heirs Ex.rs & administrators for the whole and in the whole Jointly and severally firmly by these presents sealed with our seals and dated this 15.th day of March Anno Dom 1736 The Condition of the above obligation is such that whereas the Commisary Gen.ll hath transmitted unto this Court the account of the Estate of Sarah Roach dec.d wherein it is found that there is ball due to the abovesaid orphans the sum of Forty six pounds ten shillings and eight pence Curr.t money thereof if the abovesaid Sampson Wheatly his heirs Executors or administrators shall and do well and truly pay or Cause to be paid unto the abovesaid orphans the af.d sum of forty six pound ten shilling and eight pence Curr.t money in equall parts and portions According to act of assembly when they shall arive at full age to receive the same &c Then the above obligation to be void and of none effect otherwise to remain in full force and vertue &c Sampson Wheatly (seal) Signed sealed and delivered John Handy Tho.s Williams (seal) in the presence of us Jno Scott Francis Porter (seal)
evidences on behalf of a Certain Sarah Hull and Beachamp Davis of the County af.d in Relation to the bounds of a parcell of Land Called Ledburn which they possess or any other Lands on which the same depend we therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the af.d land Called Ledburn &.c (You first having taken your oaths on the holy evangelist of almighty God according to Act of assembly in such case made and provided) and there Cause to Come before you or any three or two of you all such evidences as shall be to you or any three or two of you nominated by the said Complainent or def.t if any and that you or any three or Two of you Examine them upon their Corporall oaths to be by you or any three or two of you administred on the holy evangelist of almighty God in the presence of the Complainent or def.t if any touching the truth or Remembrances of their knowledge or any thing that may relate to the Cause af.d and that Reducing the severall depositions into writing you send the same together with this Commission under your or any three or two of your hands and seals to us to our County Court of Somerset with all Convenient speed Wittness Robert King Gen.t Chief Justice of our said Court the 22.d day of November In the 22.d Year of our Dominion &c Anno Dom 1736 on the foregoing Commission it was Endorsed as followeth vizt Somerset ss.t I do hereby Certify that on the twenty third day of November one thousand seven hundred thirty thirty and six Cap.t David Wilson Robert Jenckins Henry and John Henry three of the Commissioners within mentioned were Qualified according to Law before me Henry Ballard now |
