which to the same Joseph in the Same Court before the Justices thereof at dividing Creek afd recovered ag.t
him as of Four hundred & three pounds of tobacco which to the Same Joseph in the Same Court were adjudged
for his damages which he had by occasion of the detention of that same debt whereof he is Convict &a  and the
same day is given to the afd Joseph there &a   Att which day here Came the afd Joseph Macclester by
Francis Allen his attorney and the Sheriffe of Somerset County to witt John Henry Gent at the same
day here returned that he had taken the afd Stanton Atkins whose body here at this day he had
ready to satisfie the afd Joseph Macclester of the debt and damages afd as afd he was Commanded &a

Command was given to the Sheriffe of Somerset County that he
should take Moses Driskill Garnishee of Richard Driskill Late of
                         Somerset County planter if he Should be found in his Bailywick and
him should safe keep so that he might have his Body before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek in the Same County the third
Tuesday of June Ann Dom One thousand Seven hundred and thirty Eight to answer
unto John Purnall of a plea that he Render unto him Twelve hundred and Fifty
pounds of tobacco which to him he Owes & Unjustly detaines &a and the same day is
given to the afd John there &a

    Att which day here before his Lordships Justices at a Court then held at dividing
Creek Came as well the afd John Purnall by Francis Allen his attorney as the afd Moses
Driskill in his proper person and the Sheriffe of Somerset County to witt John Henry
Gent now here returned that he had taken the afd Moses Driskill whose Body here at this
day he had ready to answer the afd John of the afd Plea as to him it was Commanded
And hereupon the afd John Purnall declared against the afd Moses in form following vizt

Somerset County ss.t  Moses Driskill Late of Somerset County planter was summoned
to answer unto John Purnall of a plea that he render unto him twelve hundred
and fifty pounds of tobacco which to him he owes and unjustly detains &.a

And Whereupon the said John by Francis Allen his attorney saith
that whereas the af.d John at a County Court of the Right Honourable
the Lord Proprietary of this province held at deviding Creek in the County
